请问大家是不是都是在开庭之前写一封信去plead not guilty？可是我过路口的时候的
确是变红灯了，嗯。。。是事实，相信警察那边也有记录吧。这种情况我去plead no
guilty，要是输了会不会加重处罚？
如果不写信，直接出庭，有三个选项：plead not guilty, guilty和no contest。请问
这时候再plead not guilty，与开庭之前寄封信去plead no guilty，哪个胜算可能会
比较大些？
另外这个no contest和guilty有啥差别？多谢指教～～～ |

人生第一次上庭，how wonderful.
不太清楚上庭的程序，上网查了半天还是有点糊涂。
不知道是该plead guilty 还是plead not guilty，
还是plead guilty with explanation
（request上庭的时候在罚单后面选的是plead not guilty，
是不是上庭时候法官就不会再问这个问题了？？？）
我只想把记点去掉，罚点钱倒没啥，上个driving school也可。 |

发帖数: 21396 | 5 你这是法庭Arraignment，只有Plea Guilty和Plead Not Guilty俩选择。如果法院愿意
减低处罚，比方减免罚金，没有犯罪记录（不是misdemeanor）的话，就Plead Guilty
算了。否则Plead Not Guilty要再次上庭，这次是正式判决。你要不在家狂补上庭对策
，要不花钱找律师，最后就算Not Guilty了，也花费更多的钱。
当然如果你的Ticket是Misdemeanor的话，一定不要Plead Guilty，要抗争到底，否则
就会有犯罪记录，以后办啥都麻烦。 |

话说一年多前，我还不是PETS的常驻，那时候的我只喜欢狗不喜欢猫。一天跟YMcDullY
聊天，YMcDullY 给我讲了个故事：＂话说从前，一大虾去餐馆吃饭，呀，看见只猫全
身的伤，都快没毛了，给关在餐馆笼子里。大虾就去逗了逗，小猫挺随和，一双沧桑的
大眼睛望着大虾， 仿佛在说－放我出去吧，我跟你走天涯。＂
大虾被朋友叫走了，猫猫很失望的继续生活在餐馆的笼子里，等待被屠杀。
几天过去了，大虾又和朋友来同一家参观吃饭。发现猫竟然还在。主人说这猫又老又丑

16mile，警察给了张250刀的罚单。我想上庭，但是由于没有证据证明自己没超速，所

contest好像跟

时候就不能过。因为闪灯很明显，所以我一直认为只要注意闪灯就行了。
但是我觉得那天校车确实没有闪灯，我看过校车闪着灯停下来，是非常明显的。当时还
是晚上，如果校车闪灯了不可能车里两个人都没有看到。不过无论如何我确实超了一辆
停着的校车，如果一定要罚款suspend驾照我就认了。
我的ticket上没有写罚款什么的，只写了我在某天mandatory to appear at court。这
是我第一张ticket，没什么经验。如果我认了，我那天是应该直接去plead guilty就行
了吗？需要找个律师吗？如果我plead not guilty但是输了，Penalty会更严重一些？ |

如果法庭没有安排pre-trial而直接scheduled hearing，像打电话或者灯光这种小问题
，就不限期地修改上庭时间，以身体或者工作理由修改上庭时间，在上庭之前，这个罚
单都不会进入DMV档案。每次修改上庭时间都修改地越远越好，直到不能再修改，80%的
几率这个警察已经被调走或者被你折腾得不再理会你了，这样你上庭警察没到，罚单就
被dismiss.
如果警察到了，或者法庭给你安排了pre-trial，就知道找DA问他能给什么plead
bargain offer，比如DA说给你从6分降到2分，再罚钱，你一定要pitch back，说I am
willing to pay maximum fine, could you reduce it to a no-point violation? 一
般来讲，尤其是local court都是以挣钱为主，他们会接受你的offer要你的钱，除非你
的violation太严重
如果撞人了醉驾了或者超速超过100%，直接找律师。 |

如照片图，1号是我的车，从小区出来，先右转上右道，因为要在下个接口左转，打左
转灯换到左道。我的记忆是已经换好道，车已经摆直了，这个时候被2号车撞。撞击后
几秒，两个车行驶到虚线延伸的位置。我的车在左道中间，对方车在中间的换线道上。
我的车的driver side door, 车头前侧 被撞。对方是passenger side door和车头右侧
被撞。
警察给我了improper lane change的citation,说是根据2号车车窗液在地上的痕迹（如
三角形所示），是我在换道时候撞对方。但是我的记忆是我的车子已经在左道的时候被
撞的（如长方形所示，至少我不是全责。
对方的保险认定我错。我的保险说不认为是我的错，警察的判定是事后的结论，但是并
没有见证 过程（当时就我们两个车，没有见证人），所以不能就判定是我的错。现在
我的保险公司没法拿到对方的口供，因为对方请了律师，律师不允许我的保险公司联系
对方要口供。所以现在责任，保险都没有settle. 明天就是警察给的citation 上要我

首先，这只是一间学校几个项目中的一个。只有一家，湖南平江东港小学！OCEF每年资
助项目和学校过百。
其次，这个是宠物版定向捐款。宠物版版友同意也希望教育孩子热爱大自然。
再次，环保教育是指购买博物类书籍及光盘送给学校，包括植物动物知识，discovery
等。完全符合教育准则。
最后，农村孩子未能象城市孩子去博物馆，看discovery频道。他们通过书籍认识大自
然，知道世界上还有不同的生命生活在世界各地。
当城市孩子要素质教育时，你们认为农村孩子只能看应试教育教材，做习题？这是公平
？农村孩子就没权利看课外书？
回到布托事件。首先，这是受助学校领导没按要求发钱给学生。不是OCEF贪污！
其次，这件事OCEF已经处理了，要求学校退回捐款，并列入黑名单不再资助。
再次，OCEF是草根组织，每年资助很多学校。我们的监察义工都有自己的工作，只有在

我去原链接看了看，也看了plead的解答，补充几句。
2009的事情我不了解，我是2011才成为OCEF义工的。不过就我所知，象类似这样的事情
（受助学校滥用捐款，甚至象楼主举的例子，比较严重的，冒领）很难完全避免。监察
组的存在就是为了避免这种事情的发生；不过鉴于监察组的人力有限，而资助点遍布全
国，被蒙蔽的情况还是偶有发生。在MITOCEF上还讨论过，是某年手工艺品义卖的钱，
给一所学校捐了图书，结果义工走访的时候发现，图书还在包裹里没打开。 我把这个
情况贴到版上来之后，有人看了质疑，贴子我找出来了，

Japanese auto parts maker Takata Corp. has pleaded guilty to one count of
wire fraud, and agreed to pay $1 billion for concealing a defect in millions
of its air bag inflators.
The decision played out in a federal courtroom in Detroit on Monday,

LOS ANGELES (AP) — Four teenagers pleaded not guilty Tuesday to murder
charges in the fatal beating of a Chinese graduate student at the University
of Southern California.
According to prosecutors, Jonathan Del Carmen, 19, and Andrew Garcia, 18,

发帖数: 503 | 48 昨天晚上被警察叫住，说我超过了一辆停下的校车，给了我一张ticket。我后来回想了一下，确实超过了一辆校车，当时是校车在右lane，我在左lane。校车是不是停下的没有印象，但是那个校车应该没有开任何闪灯，不然在晚上我不可能没有看到很明显的闪灯。我车上的人也说没有看到任何闪灯。
我在DE，我看了一下这边的规定，第一次超过开着闪灯的校车还会被罚款115到230并
suspend驾照一个月。其实罚款我就认了，但是suspend驾照实在是太不方便了。我的ticket上写着mandatory appear at court，等我上庭的时候这种情况plead not guilty有机会吗？ |
