2. Plead guily. (Payment must be included)
3. Plead nolo contendere (no contest) (Payment must be included)
请问第二项和第三项在后果上有什么区别？
如果不想出庭，是否可以选择 no contest?
另外，如果选择 no contest并交罚款，还要被记点吗？

现在把我驾照收走了，给了我三个choice。
1, plead Guilty, pay $120. Conviction reported on driving record
2. plead guilty, register for traffic safety school, pay $147
3 plead not guilty and request a court hearing.
请问一下，能不能选3。
选3的话，如果输了官司，会不会被加罚钱？能不能一口咬定没有u turn?

今天早上开车在chamble tucker Road被警察逮到的，他测到我的车速是51,测的位置大
概和mercer university drive交界的地方，说路的限速是35。然后给了我一个单子要
上庭。以前没有遇到过这种事情，有以下问题：
1. 我看过本版以前的帖子，说可以认罪交钱就不用上法庭。5天后我会打电话去问要罚
多少钱，扣多少点。我的问题是是不是如果不扣点，就没有必要上法庭。因为上庭需要
上庭费，花的钱也不会少。
2。如果上庭的话，是不是有两个选项，plead guilty(认罪） or plead not guilty（
不认罪). 看贴子好像还有pretrial ,不知道和plead guilty有什么区别。我的问题是
我应该采取什么策略。我能说的就三点。第一 我是初犯。第二，chamble tucker Road
很多地方限速是45。警察截住我的那个点就有个牌子写限速45。第三，警察测的那个点
是下坡点。

发帖数: 74 | 21 我的court appeal 不成功，只减掉了两点。我的上庭经过可能和很多人有点不一样。我
就唐僧一把，给大家做个参考吧。
我去的是Mansfield township 的court house. 起了个大早儿，赶了个晚集，迟到10分钟
。进门已经有3，40人在排队。等着register.我就站在队里，指望着被发配去见prosecut
or.但几乎所有人都拿了张纸就让坐到court room里了。我也不例外，尽管我还跟clert
（girl) flirt了一下。最后court room 里居然坐不下，足有100多人。然后就是漫长而
枯燥的court hearing,当然其中也不乏小插曲。
最先处理的是有律师出庭的，清一色的plead guilty.基本上都得到deduction.然后是些
大案要案，有17次moving violation的，有酒后驾车的，有携带大麻的... 其间有个女孩
居然因为离开时对judge表示不满而不敬被戴上了手铐。这一下整个气氛就紧张了起来。
接下来的人都老老实实plead guilty了事。偶而有plead not guilty的，都先被威胁if

为大路上车多没能及时并线进去，而走了一小段shoulder。结果被猫在那儿的警察堵住
了。
请问这种情况上庭plead not guilty值得吗？罚了$85，这个认栽也无算了，关键是不
想以后保险费又要涨上去。
从没有去court的经验，请问是不是上庭也要交钱？还是如果plead not guilty成功了
就不用交上庭费？有经验的xdjms说说看，这种情况是认罚还是plead not guilty？

new york city好像和别的地方不一样，traffic ticket是traffic violations bureau
处理的。据说plead no guilty的下场比较惨，除了扣点不变还要多交钱。 |

诉罚单多少钱，真是很奇怪的罚单。目前我都还没有收到任何信件。刚才去网上申请
plead，竟然也没有罚款数额，然后唯一去plead的时间是一月2号8点30am，太没有人性
了吧！谁大老远从外洲新年那天跑到纽约为了去法庭讨论罚单啊？
纽约貌似给罚单很普遍，我是不是可以直接不要理了，也不付款了？我在麻省，他们会
用什么money collect agent一直追我么？谢谢！

是因为告诉堵车，就让7岁小孩坐在我妈妈腿上在第一排，没系安全带。所以拿了罚单

the defendant is Okay. Or he can hire a private investigator, follow the
defendant and deliver the pleading to him when he is shopping at Wal-mart.

变这个。
以前也有人问过关于这个一模一样的几句话。觉得有可能是想说If your appearance
is mandatory才you are not eligible for a Trial by Declaration，但是打的语法
不好，漏了“and”和多了个句号。（但是其实这样也是错的。就算arraignment的
appearance是mandatory，trial也可以是by written declaration的。）
反正你不用管就是了。
arraignment就是plead guilty或not guilty的。可以亲自去arraignment或通过邮件
plead guilty或not guilty。跟着如果你plead not guilty就有trial。trial可以in
court或by written declaration。（跟着如果by written declaration输了还可以要
trial in court。） |

看见一个ocef 著名的id 发这个贴真的很失望。康妈的行为已经不再是单纯的失去亲人
抚养自闭儿童这么简单，而是涉及到一个募捐的道德门槛问题，如果长此以往，有多少
人的善心会被滥用到麻木，ocef 里面那些贫困失学儿童的遭遇，将来靠谁来资助，里
面637个孩子，到现在还有200人没被认捐，每个人一年的费用才100美金而已，他们来
自637个家庭，，谁能来帮他们以及他们的家庭，能不能把他们的情况贴出来，让大家
看到真正需要经济上帮助的人，100块钱在某些人的眼里或许只是一个数字，半个coach
包 或许在过了几天之后早已忘记你曾经的捐助和情义，但对于那些贫困孩子以及他们
的家庭来说，那就是珍宝，他们会从心里感受到这份恩情，善良的种子以后会撒播出去

刚刚才知道，有人一直在讲所谓的“捐款提成”，原来讲的是慈善机构的运作费用（
Operation Cost）。能把这两个混起来讲这么多天，这个春秋笔法，也真是厉害了。
不知道的人，还以为张罗着给某个人捐款的，即使不经过慈善机构，也都要从中“提成
”了，或者说，呼唤别人捐到慈善机构的，也有一笔钱要装到自己口袋里了。我只能说
，极度鄙视和厌恶讲这种话的人！！
为个人捐款这个，我不讲了。因为每次具体的捐款，为不同的人，不同的理由，由不同
的人出面，情况千差万别。
我只能讲我自己有所了解的，慈善机构这一部分。美国大大小小的慈善机构多如牛毛，
真正让公众了解到有比较高的 Operation Cost 的，都是那些规模比较大的机构。
很多小的机构，本来就是一小群人，为了一个 cause 走到一起来做点事。为了能争取
更多的人支持，这些机构有的声称没有运作费用。实际上，是这些做事的人，除了花时

现在有个很奇怪的现在，拼命力挺康妈的基本都是职业“慈善”人。看这些华人“
慈善”团体里，常驻各种华人论坛上的专职拉捐款人的各种行为艺术，我觉得这15%的
提成真是物美价廉，非常划算。
周末看到一些东西，总结一下：
FakeMask和ACCEF是这次给康妈募捐的直接操办人。wuyueliuhuo（五月流火）跑不掉，
这还是快金字招牌，买买提，华人，摇篮网上都是一个账号，早就被人认出来是OSCCF
的。goodlaok(神气活现的老K)也有参与。各大华人慈善机构代言人依次亮相给康妈站
