压力了再动。不过即便如此还是99%会失败。在healthcare属于right vs. privilege这
一本质问题上拿不出consensus就永远不会有成功的reform. 而right vs. privilege的
争论在民主和选票政治中从来就不可能让理性和正确的答案获得consensus, 因此是死
结，永远无解。再加上福利如泼出去的水，再想收回来无异于政治自杀。这个

听说最近白人至上闹得汹涌澎拜，以至于很多华左朋友们唠唠叨叨地，说纳粹要来了，
纳粹要来了。仿佛这一次，狼真的要来了。
撇开他们的梦呓不说，来看看现实社会中发生了些什么。
前几天，密苏里州参议员Maria Chappelle-Nadal（以下简称纳豆）在社交媒体上说，
她希望床铺总统被暗杀掉。
纳豆一夜成名。
然后，她拒绝道歉，说，如果床总先道歉（她脑袋里把床总想象成纳粹），她就道歉。
再然后，大家呼吁她辞职，她顶不住压力，向床总道歉，但是坚决不辞职。
密苏里州的州长是个共和党籍犹太人，州长也催纳豆辞职，纳豆被搞急眼了，直接转发
了一条推，说：
“密苏里州长应该知道床铺列车的尽头是哪里——纳粹集中营”。意思是，你是个犹太
人，怎么支持这个纳粹总统呢。（有趣的是，新纳粹分子抱怨总统是他的犹太女婿的傀

特殊准许。换句话说，有一天政府不允许你就不行了，即使你想缴付费用去用也不行。
这种立法的目的就在这里。就是把权利转成准许, change right to be privilege.
你缴付了费用就是你承认了你让出你的right把它转成privilege。
然后土地能干什么就是政府的事了。现在政府是谁控制的大家都清楚。这就是为什么政
府愿意用几百倍的投入去收缴那么点费用。政府要获得的不是几十万的费用，而是对那

乎从来不能用在grant前面。这里面有两层原因，第一shall是非常容易被滥用和误解。
因为从文法来说shall在不同语境下可以等于may,will或者must。甚至很多法律界知名
人士已经强烈要求禁用shall。法学院教的时候也是教不清，或者教的人自己也不明白
，就会告诉学生shall就是must。其二如果认定shall等于must，也就是说shall grant
= must grant, 这种字眼根本不会出现在立法里，而是应该出现在判决里。grant通常
是给与某一方某一种的privilege，很难想象有任何法律会要求某一种privilege应该是
无条件可以获取的，除非加上几十页限制条件，从立法角度看这简直是开了无穷无尽的
loophole.所以may grant几乎是定例，这样可以给执法部门一定限度的自由裁量权。
