章莹颖案，目前情况并不是特别乐观：i受 害人没找到，不能起诉“谋杀罪”。。。因
为美国遵守疑罪从无原则，即公诉人不能提出确实充分的证据证实被告人的罪行，法庭
经过庭审和补充也不能查明被告人 有罪的事实，那么就只能判定被告人无罪。目前FBI
手头没有足够多的证据控告Christensen有谋杀莹颖的嫌疑，尽管联邦执法人员对嫌疑
人进行了窃 听，但就目前公开的证据来看，只能起诉犯罪嫌疑人“绑架罪”。
考据起来，这好像是从检方传出来，并且得到章YY家华人律师赞同的。这很值得华人社
区警惕。
事 实上， no body, no murder，这早已经是久远的法律历史。随着科技发展，凶嫌们
毁尸灭迹或者完全掩盖的本领越来越高，西方世界从上个世纪50年代起就开抛弃了这个
理论。 当代法律仅仅需要环境证据circumstantial evidence，就可以证明某人已经死
亡。当然，受害人还活着的可能性存在，但是极小的比例。为此这类谋杀案都不会直接
对谋杀罪成的罪犯施行死刑。

你可以说没有太大副作用，但肯定不会帮助定罪。
再说副作用，有人已经说了，调查这么多人不是这么简单的事。被告律师是法庭指定的
吧，这种情况时是不收费的，他肯定希望早早结案，你指望他一个一个的去调查目击者
？！就算不是法庭指定的，被告也没钱负的这么费用。
我觉得，可以自己偷偷去找。章家没有义务把自己找的证据主动交给被告。那是
prosecutor 的义务。只要章家不把对定罪不利的义务交给prosecutor就行了。 |

一：事由
2014年12月30号，在亚特兰大Forsyth 郡，一个搬家过程中，发生了一起所谓的性侵幼
童的案件，双方当事人都是中国人。
2016年3月30号，在Forsyth County 法院，搬家公司的张XX，被认定在搬家的过程中，
性侵了一个6岁女童。在法庭上，张被判决了犯有三项性侵罪名：第一项Aggravated
sexual battery， 这一条比较严重，为实质性的侵入了幼童的身体；还有两项：Child
molestation，（儿童猥亵罪）。三项加起来应该是65年牢狱之灾，后被所谓轻判，判
为25年监禁，还定了终身“性侵犯”头衔（Sex Offender）.
这是个孤证案，除了小女孩的一面之词，并没有任何其它物证，陪审团相信小女孩单方
面的说辞。

刚刚从法院出来，拿到法官签署同意dismiss的文书，又救了一条人命，但是我还是很
悲伤，美国这样的警察实在太多太多了！
我最近接了一个case，为一个被指控虐待儿童的华人嫌疑犯辩护，在长达几个月的时间
内，我们查阅了所有的医疗记录，询问了所有的证人，根本找不到这个嫌疑人被指控的
一点基础！但是为什么控方要用一级虐待罪起诉呢？我们无法理解！我们于是又花了半
个月的时候对所有的证据一再核对，在这个过程中，我们的发现警察在其中充当了一个
极其不光彩的角色！再直接点说，就是警察隐瞒证据导致我当事人被指控！本来这个当
事人的孩子生病了，然后他们很积极的寻求治疗，因为跟一个医生已经不一致被这个医
生陷害。即使如此，prosecutor也绝不会起诉的，因为孩子的pcp不认为父母有问题，
关键是这个警察把孩子pcp的证据证词隐瞒了，还纂改了不少证词，最终导致
prosecutor做出错误起诉的决定！！！

Last July, two Chicago Sun-Times reporters noted an allegation of "payments
made by Rezko to Obama" that surfaced in a deposition involving former Rezko
business partner Daniel T. Frawley. Since then, the only follow-up
