act 就行了。梁警官误射的一个重要原因是他拔枪之后把手放在扳机上，开门的时候
可能听到声音一紧张扣了扳机。这种行为判成reckless其实不能算陪审团过分。法庭辩
论的时候把警察行事规则都拿出来给陪审团看，基本上按照规则肯定不会走火。但是每
天违反规则的警察可能数不胜数，但是他们没有走火打死人，就没事。梁警官的枪走火
出了人命，被拉到法庭上用放大镜检查，肯定找出一堆问题来。
这个陪审团，按照报道，大都是比较年轻的学历高的白人，大家知道在NYC，年轻学历
高的白人都非常左，他们未必对亚裔有偏见，但是对所谓的警察暴力是肯定有偏见的，
所以他们在border line的情况下选择判有罪，也不奇怪。从这个角度看，华裔一定要
积极参加社区活动，政治活动，包括这个陪审团。当然，也可能DA压根就不让华裔进来
。这个陪审团黑人这么少，可能也是辩护律师的反对结果。
所以这件事的关键其实在于NYPD没有尽全力去保梁警官不要被起诉。当然也是猜测，正

1。这两个律师表现都不合格，他们刑事的经验完全不能胜任这次辩护工作。律师时候
采访的时候说完全没想到二级误杀成立，最重的就是这一项， 律师的角度看来是没把
重点放在这个控罪， 为什么？难以理解，其他4项都是从属而且是较轻。
2。开枪的原因。定义为机械故障是致命错误。证据证言不等于事实，而是证明接近事
实的可能性。可能性越大，陪审团接受的机会越大。Glock机械故障本来可能性就低，
有没有5%？你要说服大家接受这个不是搞笑吗。
3.关于梁说手指没有放在扳机上。这个其实很好处理，但是竟然没有对梁做心理测试，
没有从心理角度解释为什么梁的证言虽然不一定是事实（Might not be the fact) ，
但是诚实的 (but is honest).
正确的策略：
1- Fact: 梁是Rookie，还在培训期，没有经验应付突发情况， 也没有真实场景中熟练
的对枪支使用的经验。
2- Fact: 那栋楼是Notoriously Dangerous, 有以往的出警记录为证。

我一开始以为口令是开枪的警察发出的，所以说他“合法”谋杀，现在发现是带队警官
发出的，那带队警官有失误，开枪的警察判断出错也有失误。其他警察基本上无责。你
前面说的警察和其律师检持自己就是要开枪，并不能免去reckless manslaughter的罪
责。他的辩解只能用于被指控不小心疏忽杀人的时候，但现在是他判断失误，一样是

后冲到了高速公路中间的草地上，结果自然很糟糕，车子的轮胎和车轴都坏了，叫了AAA
把车拖了回来，最让我烦心的是警察给了我一张ticket, 控告我的罪名是reckless
driving.
我今天出庭，心里气不过，觉得仅仅是车坏了，有没有伤害到其他的任何车，凭什么说我
是reckless driving. 所以今天去法庭时，我理直气壮的plead not guilty. 那个警察先
陈述了当时的情况，他说的倒是都是事实，时间地点事情的原因经过结果等等。当法官问
我有什么解释时，我理直气壮的说了好几点：
首先，我说我有很好的驾驶纪录，开车快两年半了，是头一次遇到这种情况；
接着，我说我当时开车的状态很好，我半个小时前刚刚休息了一下，我出示了在加油站加
油的收据；
然后，我解释我的车在出发前经过了很好的检查，换了机油，和后面两个轮胎。我解释说
，修车铺只换了两个后轮胎，没有作alignment,也没有作rotation，这可能是造成事故的
原因之一；
