speed trap很恶心的, 纯粹的过路费性质。
当时就打电话交钱了事。之后贷款也下来了，绿卡也拿到了，security clearance也批
了，什么影响也没有。 |

55 speeding ticket
second time i hired a lawyer given that i am at -18 points in VA,again the
charge was reduced to simple speeding ticket. it cost 500 for lawyer and
paid ~200 for the ticket, you do not have to show up on court if you have a
lawyer
bottomline....dont hire any lawyer that cost more than 500, just go for the
cheapest one you can find. |

你就开车上高速上去超速，多拿几张reckless driving来，然后再去申请绿卡／入籍／
出入境，不就完了吗？照你的说法是一点问题都没有的。你自己去试试，all right?

另外告诉你个诀窍，reckless driving也不是你想拿就很容易拿的。比如，如果法律规
定高速上车速超过85mph算reckless driving犯罪纪录，那么如果你开到85-90mph,基本
上警察拦住你也不会给你开reckless driving criminal罚单，只会给你开普通超速罚
单。
如果你开到90-100mph,基本上警察拦住你会给你开reckless driving criminal罚单.
但你去上庭打官司，法庭非常有可能主动给你降成普通超速罚单，无犯罪纪录。

事发经过：
当时开车从北卡去华盛顿接国内来的亲戚，由于堵车，赶时间，
正好85上有一段路几乎没车，空旷无比，就开的快了点。也没
注意看速度盘，结果在Dinwiddie被当地的小警察抓了。限速
70，被抓91。虽然我开的有点快，但这91我是不愿意承认的，
直到现在都觉得被警察陷害了。
VA的特殊：
VA是一个对超速管的非常严重的州。很容易给reckless driving。
而且这个罪名不同于其他州。在其他州，reckless driving也就是

本打算昨天晚上7点半左右出发，在法庭附近订个旅馆房间，结果发现太贵。最便宜的
也得50刀，还不知道有没有其它的费项。于是决定9点过后睡觉，凌晨3点起床，3点半
出发，7点40多分钟才赶到City of Emporia, VA。原本只需2小时52分钟的车程，晚点
的原因是在抵达一片开阔地时恰好看到即将升起的日出，遂将车急停在路边打上应急灯
，拿出摄像机将整个日出过程拍了下来。
因为时间尚早，就到小镇上的麦当劳吃了一顿早餐，顺便在那里打了个盹。提前半个小
时赶到了法庭门口，将车趴在路边（2小时限时免费）。面对法庭大门时，发现法庭外
右侧的草地上架着一门火炮，炮身漆成白色，与法庭大楼的外部颜色一致。不过，炮口
被水泥样的东西堵死了。
进入大门时接受安检，再到指定房间的门口签字等候。9点20分钟时一位黑人女法警拿
起签名单后宣布了几条规定，并提醒每个人确认自己是到本房间。然后带领大家进入法

自从10月31号在virginia收到张reckless driving的超速ticket以来，我就一天没安心
过。因为在弗州超速抓的很严，我这种ticket上写着在55mile的限速区开到81mile 的
，无论是超速20mile还是速度超过80mile都足以判罪reckless driving。而这种罪行属
于轻微犯罪，严重的可能被判最多坐一年牢，吊销驾照也是很常见的。最后虽然过程很
忐忑，但判决结果终归不错，只罚了150块钱，没有扣点。
回想过去这段日子，从两个月前去弗州森林公园的路上被抓，对这黑人警察战战兢兢的
说自己第一次超速，到现在刚与该警察对簿公堂，从法官那开开心心的听到自己的判决

第一种是明知道消息是假，还传，这个不用说了，肯定造谣；

你只说了这两种，但却忽略了通常来说最关键的第二种心态，就是
不知道是真是假，但不在乎，还是说了；这个的英文叫做"reckless disregard of

如说伤害罪，比如说谋杀罪。
我们拿谋杀罪打个比方：
第一种情况-你明知道你的枪里有子弹，你还对人脑袋开枪--没有特殊理由的情况下，

第三种情况-你本来以为你的枪里没有子弹，开玩笑地开了枪，结果人家的脑袋开了花-

我是从北卡进VA的时候困了，准备进休息区的时候减速稍晚，没有转过那个90度的弯，
一直开进草地里把一个急转弯的路标撞飞，那的经理报警处理，警察来了以后问了问我
进口时的速度，然后说前几天有辆车转弯时翻车，司机的头撞到排水管死了。
然后让我自己在他的事故报告上写了事故经过，开了张reckless 的罚单，跟我说只要
是事故，都会开这种罚单，最后怎么charge要听法官的。
找律师问过，最好的结果是交高额罚款，当时VA的reckless 罚款1500－3000, 免掉点
数，我当时觉得我没错，直接自己去了法庭，认罪不认罚，法官问了警察，警察就按照
我当时写的经过念，法官说不是reckless，交了169刀就给放了，目前我的纪录还是满
分加两点。
关键，reckless 的charge一定要免掉。 |

5年前在VA读书的时候，我一个身边很好的朋友就是在I-81上开到85以上吃ticket，最
后花了好像6、700刀请了律师求情，最后还是要强制执行社区服务，否则有criminal
driving record影响绿卡申请，虽然是5年前的事情了，但记忆犹新。
