我的理解是这样的：法官并没有对那个EO本身做出判决。他只是在原告的要求下，同意
发出一道TRO（temporary restraining order，临时禁制令），临时性地阻止EO的执行。
TRO的目的是保持status quo，防止对原告人产生不可逆转的伤害。关于EO是不是违
法或违宪，法官并没有（也不需要）作出判定。他只是认为如果原告进一步打官司，
原告有可能会胜诉。再加上其它三个条件也成立，法官就认为可以发出TRO了。
如果在随后的上诉中，原告赢了官司，那EO就自然就永久性地失效了。如果输了，
TRO就失效了，EO可以接着执行。
说到底，川普这次的执行有很大问题，该搞清楚的法律性问题没有拎清，一拍脑袋
就上了。不过，这倒也是他一贯的风格。 |
