发帖数: 533 | 1 lp最近fail了系里的一个考试，学位拿不到了，只好从F1转回F2，申请change of
status。
本来这个学期只注了论文课，如果在这周日2/2之前退掉可以少交点学费，但是退完后
F1身份就要terminate（IO说会在21天内中止），就会out of status。
IO的建议是不能退课，不但不能退，而且下个quarter也要注册，还要注9学分来保持
F1身份，直到转身份被批准，因为申请change of status需要的时间很长，可能要
2到4个月，说如果out of status了，申请转身份有可能被deny。
我的问题是从uscis网上查到， What if I file for change of status on

pending adjustment applicant.” The problem with this status is that if
your I-485 is denied, for any reason, as a “pending adjustment applicant”

对
first-year choice只是从nonresident变成dual status的过程。dual status不能报
married filing jointly。要“进一步申请为full-year R”（用choosing resident
alien status或nonresident spouse treated as resident）才能报married filing
jointly。
resident的期间要报全球收入。所以全年resident要报全年全球收入；dual status要
报resident那段时间的全球收入。
first-year choice只是从nonresident变成dual status的过程。一般单独变成dual
status没有意义，因为dual status不能合报，也没有standard deduction，等，不比
nonresident有什么好处。已婚的人可以进一步从dual status变成全年resident合报。

8月6日收到ITIN号。

“如果out of status了，申请转身份有可能被deny”是错的。只要in status的时候申
请了change of status就行了。后来out of status无所谓。
对，F1身份terminate之后技术上是叫out of status。但是“out of status”不是什
么坏事。有一半申请绿卡的人也申请后有一段时间技术上是out of status的。

过期日起算。

怎么可能没有I-94？每次进入美国就应该有I-94（或电子的I-94）。转身份也应该给你

紧FILE NIW,本想利用累计未修的年假（440小时，可以最多修240小时）争取一点时间

跟你说的相似，交上去后一段时间没有变，然后在6月29日status time变了但是status
没有变，在7月2日status time和status同时分别变成7月2日和recommended。
我个人觉得很有道理。这样就可以不用等到据信就可以准备recycle了。

所以那个5000免税的treaty如果你替你老婆选了resident aliden是不能claim的。。。

一些fellowship,但是这些钱并没有体现在她的w2里面。关于中国学生的treaty，是不
是scholarship or fellowship 都是免税的，而且与filing status无关阿? 因为这笔
奖学金是分成几个学期发的，好像都没有扣税。如果真的与filing status无关，我想

status怎么都比NR强啊。
1. NR和dual status都不用报海外收入。
2. dual status有$3800的personal excemption，NR没有。
3. dual status的itemized可以包含州税，NR不行？
4. tax rate， NR30％，dual status的那个税表看起来不到30％。

估计是
要符合2014年的substantial presence test，要2014年的天数 + 1/3 2013年的天数
＋ 1/6 2012年的天数，达到183填。所以你从183减去2013年里10月开始在美国的天数
的三分一，那就是你在2014年要多少天在美国才符合substantial presence test。

如果是dual-status，是这样报的。但是你们不想报dual status。dual status是不能
报married filing jointly的。你们想报全年resident。你们dual-status后需要用
nonresident spouse treated as resident才能报married filing jointly，两个人都
全年resident。

你哪里听到可以deduct这些？这些钱是公司出的，不是你出的。 |

后两种都有 residency，反正都可以有 dependent 身份。
看大家在争议要不要冒罚款风险来claim父母为dependent，突然想起父母好像应该算
dual status的问题。
虽然前面十几年大家无数成功案例说明父母可以算dependent，但他们究竟是以R的身份
作为dependent，还是以dual status的身份作为dependent？
虽然这问题不重要，但我想起另一个case，F1转学术界H1b，如果H1b超过183天，大家
都默认是报全年R的1040，但按理解，应该是报dual status partial R才对？ |

但是公司不会去REVOKE我的H1B，因为律师是我自己找的。
现在准备回学校去读完我的MBA。
但是学校说， 我如果要回去从8月份开始读的话，必须要等到3月22 号以后 才能FILE
CHANGE OF STATUS。 （因为8月份开始读的话，我有奖学金可以COVER我的学费）。
如果我现在要申请CHANGE OF STATUS的话，必须要从5月份开始修SUMMER的课，这样就
要自己多交5000多的学费。
想请教一下板上的大侠们，我可以在3月底再去学校申请CHANGE OF STATUS码？这样
可以帮我省丢SUMMER两门课的学费。毕竟5000多也不是个小数目，对于我来说。因为我
知道理论上来说，我必须在2月16号前申请 CHANGE OF STATUS。
看过板上很多其他的帖子，本来想转B2，但是看了一些人说 这个不太容易过，而且以
后对重新找工作有负面影响。

jointly as residents”，但是在519里面，PAGE 31，里面有“Restrictions for
Dual-status taxpayers”，第四项说“cannot file a joint return”, 到底能不能
一起FILE?(F1 + H1, H1是DUAL STATUS)
另: 04年9月来美,08年6月底毕业,7月回国,8月初回美直接签H1回来,08年H1身份有150
天.要是FILE EXTENSITION, 可不可以按RESIDENT报,必须报DUAL STATUS吗?(结婚了)
按照 SUBSTANTIAL PRESENCE TEST说,应该是RESIDENT, 考古说F1不算,那转了H1后算吗?

我2010年1月29号H1b签证从中国大陆来美做博后，一直到现在。之前没有拿过F， J等
签证，也没
换过签证，没结婚，是single。看了pub519好像我2010年是dual status。根据pub519
，我在
2010年1月29号之前是nonresident alien，因为我在2010年底是resident alien，所以没
有first year choice，然后又因为是single，不能choosing resident status. 所以就
是dual status。
但我看精华区和置顶的guide，我应该就是resident alien啊，好像dual status是指从
另一个
签证（如F，J签证）转到H1b签证的时候才有的状态。
我的情况应该很简单啊，我怎么就搞不明白呢，请指点迷津！ |
