楼主本来很高兴打算把公司信息发给学校ISO去给SEVIS登记。
但是老板却很诚实的告诉我，他们公司一周前刚刚递交Subsection S corporation的申
请，
需要三周时间才能完完全全登记在政府，目前是pending incorporation的状态。
楼主现在就很担心，怕SEVIS会审查我发过去的公司信息，怕不让通过。
跪求各位有经验的前辈指教！
PS：
我之前听说SEVIS不怎么上心，收到信息就给登记到系统里了。
除非是你被别人举报了，移民局才会要求你出示offer letter等必备材料、审查你。
而且这一般都是发生在挂靠公司人数过多的这种情况下。
我也是听别人说的，不知道是否正确。楼主现在真的很担心！ |

pending 换工作的 180 天
提交 I-485 之后，更换雇主或工作，大家知道的有
1) I-140 已经获批；
2) I-485 提交了 180 天未决；
3) 新职位和 I-140 上的职位是相同或相似。
这是指雇主支持型的，象 NIW 等是没有 180 天的要求。但职位的要求，都是一样。
如果还没有提交 I-485 就更换雇主，你需要重新开始 PERM 和 I-140. 批准了的 I-
140 的排期，可以保持。
在 I-485 提交之前就换了工作，之后的 I-485 就一定会被拒，除非 I-140 的老板还
保留着你的职位，等你拿
到绿卡后回去工作。在这种情形下，回 RFE 的 EVL 应该由 I-140 的公司出，而不是
目前的雇主。
而同学们最关心的，莫过于这个 180 天的时间。
是不是 I-485 提交之后不足 180 天，就一定不能更换工作？或者换一个方式问，在 I
-485 提交之后不足 180
天之内换了工作（或是被 laid off 了），其 I-485 就一定作废了呢？

这条条文的标题是"EMPLOYMENT-BASED IMMIGRANTS NOT SUBJECT TO PER COUNTRY
LIMITATION IF ADDITIONAL VISAS AVAILABLE"
意思说如有剩余名额(IF ADDITIONAL VISAS AVAILABLE)，就不受国家配合限制（NOT
SUBJECT TO PER COUNTRY LIMITATION），注意，它说的是不受"COUNTRY LIMITATION",
而不是如奥傻解读的，Regardless of Chargebility，或者说Regardless of Country.
他把"COUNTRY LIMITATION"偷换概念成“COUNTRY”了。“COUNTRY LIMITATION”中
Country只是修饰LIMITATION的定语，重点在LIMITATION，而非COUNTRY。

我没有参与过法律诉讼，所以我只能想象法官判定的两个依据：
1、法律上明文规定。这需要对法律的仔细研究，我阅读了关于名额分配的法律条文，认
为我们至少不吃亏。
2、一些基本原则。我对打官司的第一点信心来源于，平均分配是整个名额分配的基本原
则，只要把目前实际分配方法一列上，再加上几个极端的例子，就可以清晰的说明其对
平均原则的破坏。法官再笨也知道目前分配方案的荒谬性。
而我对官司成败的最大信心在于以下内容，yijiayan的帖子里写得非常明白，我再简单
说一下：
