提交 I-485 之后，更换雇主或工作，大家知道的有
1) I-140 已经获批；
2) I-485 提交了 180 天未决；
3) 新职位和 I-140 上的职位是相同或相似。
这是指雇主支持型的，象 NIW 等是没有 180 天的要求。但职位的要求，都是一样。
而同学们最关心的，莫过于这个 180 天的时间。
是不是 I-485 提交之后不足 180 天，就一定不能更换工作？或者换一个方式问，在 I
-485 提交之后不足 180 天之内换了工作（或是被 laid off 了），其 I-485 就一定
作废了呢？

一般大家的认知是：只要批准的140没有欺诈（fraud or willful misrepresentation
）都可以保留PD。
我查了一下USCIS的有关法律条文，与之相关的是以下两个文件：
第一个文件是09-12-2006发的Field Manual，这个文件陈述了I-140表格上具体审核的
每条内容，是指导具体处理申请的移民官如何审核I-140的工作手册，甚至涵盖了申请

发帖数: 563 | 12 我是新人，昨天和今天看了大家的讨论，提案的全文刚才也跳着看了几段自己关心的，
总的感觉就是：以后职业移民门槛会高，但名额放宽，同时打击abuse system的公司，
所以职业移民以后的着眼点就是真正合格的worker但要大量引进。对个人来说，如果有
本事公司花大价钱也肯雇的，或者或者已经有H1B的，都没啥好担心，是利好，以后真
正合格的职业移民应该不会有那么长的排期。但通过后准备那些在小公司里混H/L签证
的可能不那么容易了。
另外有人提到以后不用走职业移民了，拿灰卡（呵呵，我发明的词儿，就是RPI了）10
年后转绿卡。其实就是两条路而已，一条是职业移民，拿工签，等个2，3年就拿绿卡。
另一条就是非法的，拿灰卡，等10年中间不能享受福利。就看你选哪个。当职业移民不
需要排期那么长的话，肯定合格的人们还是会走职业移民快速拿到绿卡，灰卡还是给劳
模的。另外这个灰卡不确定因素很多啊，提案一开始就说：

经常不及时。这其实是一切排期反常现象的根源。
其次，移民法允许 DOS 使用“合理的估计”来预测 visa 使用量，并基于这个预测来
制订排期。如果你仔细看 visa bulletin，菲律宾这个国家的 EB 只有 EB3 排期需要
特别制定，其他类别都是 current。而菲律宾 EB3 的排期基本上前 10 个月是按每月

中印，没有country 3。第二轮超过7%的部分，也就是SO的分配奥本长年来顽固坚持只
看PD，不看国家，由于印度PD早，拿走了绝大多数SO。NIU曾无数次与奥本交涉要求SO
分配不能只看PD，也尝试了议员campaign，均无果。NIU提出的分法包括SO部分中印对
半分，或者SO部分中印按各自库存比例分。图中的分法是要求SO部分中印最多各拿SO部
分的7%，如再
有剩余再来分，这本质上就是中印SO对半分，只是把如何对半分的流程具体化。
奥本的坚持按PD分的理由就是INA203(e)中列出的一条general的PD原则

章里面对于当前生效的美国法律（具体来说是关于H-1B延期的条款）做出了错误解读，
可能会误导很多人。因此，我认为有必要澄清“北大飞”这两篇文章中的错误，包括似
是而非和不完整不明确的地方。

瑞士没什么mall culture
没有很大的连锁department store像英国Harvey Nichols或者Selfridge专卖designer的
Grieder算一个吧，但东西不多我觉得
另外有个Trois Pommes是很多很多小店，每家卖一个subsection，比如men's casual之类
要是一般的department store，那有Manor，苏黎世还有Jelmoli,Globus

基本意思是能逃的话就不能使用致命武力，但1)在自己家里例外（如果自己不是挑事者
），2)警察执行公务或者普通人帮助警察执行公务必须使用致命武力例外。
2C:3-4 c. 进一步解释了对擅闯私宅者经警告无效又对你构成威胁的，可使用武
力或致命武力。

一个周末的早上7点在一个红灯路口右转（没有no turn on red)的标志。 我在猜是不
是应该没有full stop? 不过当时车速也很慢。
想appeal一下， 看看能不能求个情之类的。不过ticket上只有怎么pay ticket的
instruction， 没有说怎么通知court去plead not guilty. 有经验的朋友能不能指点
一下？
另外这ticket上有一句：" the law provides that a violation of 39:4-81 - Red
light camera subsection only - shall not result in the assessment of moto
vehicle points or automobile insurance eligibility points", 那么就是不会扣点
吧？ |

发帖数: 1898 | 49 昨天晚上用IRS提供的免费报税公司名单里面的3个公司报税。
第一家是我去年用过的，refund的金额9xx，跟我的预期差不多。可是我选的是1040EZ,
没有让我填我的scholarship和claim life time learning credit。我想修改成1040，
但是花了2分钟没找到相关按钮，也不让我重新填一个1040，然后就算了，没有submit.
第二家FYT，我就不具体说哪一家了。这家的设计比较fancy，举个例子，在w2填写那里
，你填了EID，它就直接天上employer的名字和地址之类的，到最后summary的地方也很
fancy。可是用它家算，refund只有2xx。这家我用的是1040，可是没让我claim life
time learning credit。当然也就算了，我又不是傻子，2xx是我预期的25%，没有
submit.
第三家123，这家1040很详细，超级详细...但是不难，如果你有所有的报税所要的文件
，也是很轻易能填下来的，就checkbox和填数字而已。需要填的填不需要填得跳过，它
不像其他让你看完整个subsection,它给你一个t |
