去年8月31日入住的,签了一年,是通过了一个类似中介的地方,现在想回国,sublet
不容易啊,因为学生都走空了,也只能提前中止合同了。
仔细研究了cantract,并没有说明关于提前搬走需要多付多少的问题。
当时中介要求付三个月的房租,一个是第一个月的,一个是最后一个月的,还有一个月
的是deposite。也就是说现在我们还有两个月的房租在房东那里,我们就不知道这个最
后一个月的是个什么意思,是说我们如果搬走了,就必须多pay一个月嘛?但合同并没
有说明啊,大家说我可不可以不pay五月份的房租,就和房东说,这个月的房租我不给
了,我当时pay给他了最后一个月的房租?
毕竟是学生,能挽回一点是一点,大家能不能出出主意啊?拜托了!
以下是合同里关于提前搬走的条款:

开始不太明白那个bond是什么意思,猜想是租房押金。后面看到解释,果然是押金,但这押金原来不是放在屋主那里的,这Bond是放在the Bond Centre。如果租住过程中有物品损坏,而你和屋主又有争议,那么就去the Tenancy Tribunal寻求仲裁,然后利用Bond来赔偿。
真是公平交易,童叟无欺呀!:}
相比国内,押金肯定是交到屋主的啦。还有居纬会只会催你办暂住证收钱,催屋主交管理费,哪管什么争议不争议的。shit!8-( |

去年夏天开始工作不久时,因为我的公司在El Monte,老公在Industry, 我和老公就搬到
El Monte租了一个Studio, $660/Mon, 房间不大但很高,因为是贴着房东的两层house加
建的. 说是能做饭但是只有一个灶台和水池, 切菜都没地方,优点是比较安静离我公司
很近,水电网什么都包房东阿姨还时不时的给我们做点菜. 刚开始我们挺满意的,虽然坏
境比较破(毕竟是老墨区么),但是觉得终于有属于自己的小家了(以前一直跟别人合租).
可是日子长了,房东本性暴露了,简单罗列一下:
1. 不让我们开暖气, 说她自己从来不开暖气也不冷. 可是我们的房间挑高辽?米, 窗
朝北, 12月一月晚上不开暖气根本睡不着.
2. lease上写如果有外人来住超过14天要加收$100. 我朋友过来过个周末,她就一定要
收那100块.
3. 她所谓的包网,就是一整户七八口子用一个什么所谓光纤的估计也就19.9一个月的网
络. 网速慢到让人崩溃, 有时候打开个google都要一分钟.

如果没有,那就是joint tenancy without survivorship。王和李一人一半,王死后,
他的那一半按照遗产分,李和孩子各得一份。
但是如果李被定罪谋杀王致死,在有些州,李就不能再继承王的遗产了。不知道新泽西

contract,到时候自动转成month-by-month的,房租不变。
结果今天给我们寄来一个新的Notice说要续约涨房租,涨25% (2000->2600)!!!!
而且只有提前40天告诉我们,太ridiculous了!!
之前的合约条款里有一条:
If the landlord must offer a renewal lease, the Landlord shall notify the
tenant of the renewal lease at least 65 days before the end of the term
unless the tenancy is month to month.
转成按月算,我们挺满意的,正好也在看房子买。
这种情况是不是可以我们坚持要求转成按月算,然后交老房租的?因为对方没有提前65
天告诉我们,而且还是我们去问了的情况下。

Periodic tenancy by month需要至少一个月的时间提前通知,而且房租时间是以整月计算。

室友太吵那个我向房东complain过,房东说如果我跟室友之间有written agreement的
话,他才能干预,否则的话法律上他不能管这个事。因为这个室友当初是我自己找的,
入住前都口头说好的,没有任何written agreement,谁知道这个人习惯非常恶劣,厨
房卫生什么就不说了。所以我实在没有办法。

如果是community property with survivorship ,则自动transfer, 如果是(比如)

细读了一下合同,里面有一句:keep the premise clean, sanitary, and in good
condition and, upon termination of the tenancy, return the premises to
Landlord in a condition identical to that which existed when Tenant took
occupancy, except for ordinar wear and tear.
这种情况下,我是不是有责任在搬出去前让房子恢复到房东可以马上挂牌的状态?比如
要请人清洗地毯,粉刷墙壁?一般租房是这样的吗?第一次遇到这样的事,有谁知道吗

l******0 发帖数: 114 | 47 来温哥华之前,朋友帮租了本拿比的房子,住着也舒服,挺好。由于孩子上学的缘故,
决定搬到西温。暑假想回国,怕开学前太匆忙,所以现在就到西温找了不错的房子并马
上签了合同(7月入住)。由于英语还没过关,尽管做此事之前阅读了本拿比公寓的合
同,以为不到一年提前终止合同,只要陪付200元就可以了。没想到,当提前一个月给
物业书面通知的时候,他们说如果房子租不出去,合同就要继续直到一年期满。也就是
说,还要再交两个月的房租(9月到期)。
没办法,又跑到西温问人家是否可以退租,两个月以后再来?答案相同,如果房子租不
出去,也是要赔款,因为已经签了合同。天哪,这个乱!初来乍到,不了解加拿大的法
律。按说应该先去物业问清楚再办事,但头痛英语交流,只是读了读合同,按照自己的
理解,就造成了现在的尴尬局面。
我去问物业经理,除了200元我能理解以外,哪个条款是说我要继续合同的,她的解释
就是该条款的后半段。请各位大侠,有英语好又懂法的帮我看看,他们讲的是否合理:

位分租给几 个国际学生,又拖欠租金半年。他甚至不讳言自己靠分租
维生。
CBC电视台于2009年报道,梅西纳以1,500元月租,租了温哥华一个570平方呎的一房柏
文单位,自己没有住,却分租给多个日本和韩国裔学生,月租由400至900元不等。2008
年11月,卑诗住宅租赁办公室(Residential Tenancy Branch)因梅西纳拖欠租金勒令
他搬走,但他上诉。基于法例所限,当时 的柏文?垭单位业主福克斯(
Elisabeth Fox)也拿他没法。
梅西纳堪称?垭职业「租霸」,有多项因欠租被逐出柏文的纪录。
