露。”至于是否故意，不是警方说了算，要jury来定。这也是VA裸体男脱罪的原因。

told the plaintiff that you didn't prove your case, so tough luck,
judgement for the defendant, you pay the court cost. The fact we have these

，在从前却并非如此。我们今日认为理所当然的一切，不是美国立国之初“国父”们(

折争取来的。
就比如，如今人们认为“出生公民权”是再自然不过的事：在美国出生的婴儿，不管父
母是何肤色，国籍和移民身份，一律自动成为美国公民。但在一百多年前，人们可不一
定这样认为，还真的就有人明明就出生在美国，但因为他的种族，不被承认是美国公民

你说的国籍法后面几条只是列出了“几种情况”，在这几种情况下，如果有了外国国籍
就会导致中国国籍被取消。但是除了列出来的这几种情况之外，拥有外国国籍并不会导
致中国国籍丢失啊。
按你的观点，你是不是认为，只要A国的法律列出任何一种情况A国公民加入B国国籍会
导致他丢掉A国国籍，那么A国就算事实上的“禁止双重国籍”？如果这样的话，美国也

真不明白，美国的言论自由有什么模糊不清的，还有人弄不清？这是很清楚的法律概念。
美国宪法第一修正案的原文如下：

，在从前却并非如此。我们今日认为理所当然的一切，不是美国立国之初“国父”们(
the founding fathers)的恩赐，而是我们的先辈在过去上百年里经过艰苦斗争费尽周
折争取来的。
就比如，如今人们认为“出生公民权”是再自然不过的事：在美国出生的婴儿，不管父
母是何肤色，国籍和移民身份，一律自动成为美国公民。但在一百多年前，人们可不一
定这样认为，还真的就有人明明就出生在美国，但因为他的种族，不被承认是美国公民

黄金德是1871年出生在旧金山的华人。1882年排华法案通过后的1895年，黄到中国旅行

其中之一，自己的case很类似，甚至更为严重（CP membership终止才2年3个月，提交
485时刚满2年，主申请人，TSC）。所以把自己所知道的写出来，希望能和大家讨论一
下，争取能阐述清楚一些事实，形成大家进一步讨论的基础，最好能集合大家的力量能
为“党员+ 485”问题提出一个妥善的应对方案。只针对问题进行探讨，谢绝各种人身

我从人有限的智力角度上考虑，去思考那些没有经验的极限问题不是很必要，也很可能
徒劳，因为我们的理解力是有限的,大脑的计算能力也是有限的，语言的表达力也是有
