发帖数: 1430 | 19 我觉着加强边境安全还是有很多事情可做的，比如修建更多的隔离墙，派遣国民警卫队
这样的准军事部队去边境协助DHS实施移民法，允许地方的警力执行联邦移民法规和协
助DHS的官员执行联邦移民法规，以及要求所有雇主参加E-Verify等等。都可以很好的
加强边境安全。尽管不可能100%消除illegal immigration, 但是可以很大程度上改善。
另外，我觉着如果比较STEM和recapture来说，我觉着STEM更加符合Republican的胃口
，如果能把这个STEM的条款加入Republican支持的job creation的法案就好办了。对于
job creation, 共和党是全力支持的。
我觉着共和党反对的是非法移民以及合法移民中的unskilled worker. 对于合法移民中的高科技移民他们还是很支持的。 |

发帖数: 2829 | 31 你看错了，每年限额 7.1% of 140000讲的是EB4，不是EB3，更不是什么7% of 5000，
况且那5000也是EB4里面的一个限额，跟EB3毫无关系。
EB3里面的EW确实有个全世界的限额，是每年10000，但EB3C年度限额2503是包括EW的，
所以你不能排除EW来单独计算余下的EB3C。
另外你说“中国的 EW 绝大多数都是 CP。”也是错误的。根据最新FY11公布数据：
http://www.travel.state.gov/pdf/FY11AnnualReport-Table%20VI-Par
中国EB3C CP总共实批1492，其中EW只有404，而普通EB3C有1088，仍旧是占绝大多数。
并且我计算的EB3C CP比例是根据实批数据计算，所以所谓CP 拒绝率远高于 I-485之类
的因素完全不需要考虑。
综上，我计算的EB3C CP:485总比例1.42正确无误。EB3C里面的EW CP:485会高于1.42，
其余EB3C的CP：485比例略小于1.42，但EW总体比例很小，不影响大局。

基本名词解释: STEM = Science Technology Engineering Mathematics

You go to china town, you see a lot of ppl, unskilled or aged, who dont even
speak english have GC's. They take the GC from you and uncle Sam takes

标 题: EB2 占用 EB3 名额的一个新思路

按：本文是上个月写给 NIU 会员的。如果懒得看全文，可以提前告诉你结论是：EB2
占用 EB3 名额虽然字面上是不违背移民法条文的，但是目前实行的联邦规定不允许这
样做。如果有 EB2 的人愿意争取 EB3 的“剩余”名额的话（如果有），可以尝试从这
里面做文章。
根据移民法规定，在一个国家 EB/FB 总额不足 7% 时，所有类别的排期都和 ROW 一样
，也就是说可以在任意类别中占用任意多名额，只要总量不超过 7%。而一旦总量超过
7%，即变成 "oversubscribed" 国家，在排期中，是该国家至少有一个类别排期早于该
类别 ROW。但是，要求 oversubscribed 国家所有类别都受到 7% 限制，这就显得不够
合理了。
从本期 Visa Bulletin 来看，EB2 成为中国大陆唯一一个排期早于 ROW 的类别。

1. Professional,这种是要求本科学位以上的
2. Skilled-worker,这种学历不要求,但是要经验
3. Unskilled-worker, 好像也叫Other-work,这个排期在04年, 你肯定不是的,所以我
猜如果不要求学历就只能是第二种了, 如果就是对号入座本来就不要求学历那学历就不
是问题.

，亲戚想咨询美国有没有律师办这种。希望国内亲戚没有被中介忽悠啊。有同学见过这
种途径来美国然后过一段时间可以顺利申请美国学校读书的？谢谢大家！ |

去领救济金咯。
德国当年缺乏labor force， 从土耳其进口了人口做清洁工，餐馆工；
瑞士同样， 从非洲进口劳力。 劳动市场一直会有未受过专业技能教育的人售卖labor
， 社会缺不了他们。那些unskilled 和less skilled worker, 从清洁工,保姆，伺应
