这个说明USCIS 有这个想法，在争取意见，说实话我自己也不相信我们能对美国经济起
到什么巨大作用，可是现在美国的经济萧条却很可能是我们的机会。病急乱投医，政府
试过各种手段，经济还是不起效的话，也许就会试试移民这跟稻草。记得以前上海用过

We have done many service requests, info pass, attorney letter and
contacting senetor (not helpful). USCIS kicked our case from TSC to Local
office back and forth. The estimated reason is that they lost our files.
Because we've been interviewed in 2009 and the decision was hold on for "
Visa Avaiiability".

第二排期本来一直都是给cp用的（见奥本对lawsuit的证词），这次修改是因为uscis没
法接受按照cp日期划定的cutoff带来的工作量所以吵着要修改日期。
那么问题来了，如果一开始第二排期就是为aos制定的，为什么第一版十月VB没按照
uscis的要求直接设成1/2013？
答案显然是本来第二排期就是奥本用来指导NVC收CP的，没AOS什么事儿，所以压根没考
虑USCIS收AOS的工作量。这次修改也只是因为USCIS的抗议，压力太大临时修改的。以
后不管USCIS每个月是否决定使用第二排期收AOS，奥本仍然会按时发布并且继续用第二
排期指导NVC向CP申请人发通知，收申请材料的。
跟您就这个问题发了也有十来个帖子了，既然谁也说服不了谁，也没必要再回帖了。
当然也没必要争嘴上占便宜，谁脑子清楚不清楚，理解力有没有问题，素质高不高，看

因为要求降级，USCIS不受理，因为目前把CASE转到LOCAL OFFICE。于是找众议员参议
员催。等了几天今天收到议员回复，这是我从来没有见过的回复，上来给大家分享一下
：我觉得这意思就是怀疑我们是恐怖分子，要一级戒备。我不知道这是啥意思，按说我
们的情况太简单了，结婚12年，有美国出生的娃娃，我大学毕业就在现在公司上班，连
中国都没有回去过。公司不算大但是正规上市美国公司。有种感觉我将会是2012年最后
一个被批的，有决心等到2016年年底。

后才在USCIS网站上看到递交的时间，并且当时USCIS 网站刚开始公布八月排期的时候
，居然搞错了，EB1B仍然是C，当时好几个战友纷纷说USCIS不鸟查理的排期，其中一个
网友说很有可能是USCIS的网管拷贝了上个月的网页，所以导致了这个错误，结果果然
被其言中了，仅仅过了半天USCIS网页就更正了过来，因为当时我也正犹豫要不要在八
月前突击递交485，所以对这个记得很清楚。绝对是在七月底的时候更新的网页。 |

另外，USCIS可以不用或改动二排，但是奥本的一排Final Date, USCIS能改日期吗？

我觉得10天之内这个日子不改，基本就不会改了。

日期？你律师没弄明白withdraw之后I-140的状态。withdraw的主语是雇主，revoke的
主语是USCIS，这两方都可以自行其是。2016年的新规定出来后，一个批准后的I-140的
状态有4种可能状态，1) approved and not withdrawn, 2) approved but withdrawn,
3) revoked but not withdrawn, 4) revoked and withdrawn. 状态1）2）PD保留，
但只有状态1）可以用来直接申绿卡，状态2）意味着有PD但PERM和140得重来。状态3）
4）都没有PD。状态3）在上诉期内还能上诉，状态4）则什么都没有了。
你律师大概误以为只有有效/无效二种状态了。在这个误解下，雇主withdraw后使其无
效，USCIS就不会多此一举再revoke使其无效了。但实际上并不是只有二种状态，而是

发现收据上的A number和律师填485交给USCIS的A number不一致。估计uscis小二录入
系统时候出错了。
9个数字中8个数字都对的上。把第三位6写成9了。降级双飞交的表。USCIS把以前EB2-
140
的A number是A206-×××-×××写成A209-xxx-xxx.我这种情况要去找USCIS重新改正
吗？
如果要找USCIS，是不是要去做infopass还是打指纹的时候跟小二讲？还是电话t2小二？

发帖数: 102 | 36 USCIS今天公布了职业移民和非职业移民申请的最新审理程序。自2006年4月1日起，USCIS将按照递交申请的类别，而不是地理位置来处理上述类别的申请案件。不再由四个处理中心各自处理所管辖区域所有的申请案件。
VSC 和CSC将负责处理全国所有的I-129申请，包括H﹐K﹐L﹐O﹐P﹐R 及其家属递交的相关申请。但是申请材料应当寄往VSC。
NSC和TSC将处理I-140职业移民绿卡，以及相关的I485调整身份的申请。申请材料应当递交到NSC。
在此，我们提醒等待4月1日递交H1B申请的雇主，务必使用VSC的地址，以免延误申请的审批。
此外, 3月22日起我们开始收到USCIS电子通知：一些审核中的I140移民签证申请从CSC移交到了TSC。尽管移交通知表明申请被移交的原因是TSC对案件拥有裁定权,但事实上在递交申请时，CSC拥有裁定权并且申请确实在California递交.

对于申请人在回答移民局RFE (Request for Evidence) 后，其案件何时会得到结果，
USCIS最近发布了有关的timeframe。根据USCIS，如果申请人在提交其RFE response的60
天后仍未收到移民局的回复，申请人可以查询其RFE的情况。如果在此后的30天之后仍未
能解决问题，申请人应当联系USCIS National Customer Service Center(1-800-375-
5283). 但以上并不适用现时大量的I-485sRFEs，希望USCIS在未来会对其发布有关

科普一个常识，h1b是共和党搞得，opt也是共和党搞的，opt extension还是共和党搞
的。Stem绿卡过去十几年每年都是共和党在嚷嚷然后被民主党毙掉。
川普不过说了句，要执行USCIS现有的制度，什么制度，对有疑问的EB申请人要面试

EB23没有换过工作的不面试，换过类似工作符合AC21的不面试

剩下的类别是什么？485一周跳槽而且SOC code不一样，不符合SOC。这种情况理论上必
须重新提交140，想要蒙混485 portability本来就是擦边球。有什么叽叽歪歪的？
USCIS连网页都懒得更新，因为这完全是他们行政范围内的自由度，以前有法不依的规

公民及移民服務局(USCIS)日前發布公告，表示將改進目前「外國人權益核實系統」(
Systemic Alien Verification for Entitlements，簡稱SAVE)，新增蒐集移民身分信
息。移民局目前正向政府部門收集意見，為期60天。移民律師李定一表示，這有可能是
為日後調查移民濫用公共福利的措施鋪路。
SAVE項目是旨在幫助聯邦政府、州政府或地方政府機構在移民申請政府福利時，驗證申
請者的移民信息的項目。該項目有1億多條聯邦政府紀錄，是自願加入項目，目前全美
已有1000多個政府機構通過SAVE驗證非美國公民申請者的移民信息，幫助相關機構確保
只有符合要求的申請者才能領取福利。參加SAVE項目的政府機構，通過提供申請人的姓
名、出生日期及移民身分文件的信息，就可通過系統進行核實。該項目擬推廣至全國。

今年初USCIS公布有一些有关H-1B的申请指引。以下为一些值得注意的内容：

根据8 C.F.R. 214.2(h)(2)(B) ，申请人要注明其工作地点以及雇用时间。

根据8 C.F.R. 214.1(c)(4) ，在进行H-1B transfer申请时(包括consulate申请
)，USCIS要求申请人应能显示其为旧雇主工作过一段时间 (a significant length of
time) 。这显示出USCIS有意加强其对H-1B的审核。尽管所谓的“a significant
length of time” 并没有明确指出究竟是多长的时间，但对于哪些想很快转到新雇主

取付钱给ICC, multiple filing through different employers 以增加他们抽中的几
率。相信所有努力读书，认真工作的同胞们都无法接受这种事实。本人有2个offer，都
是fortune 100的公司，但是我选择了其中一家帮我申请h-1b。我认为美国是一个信用
社会，work ethic从一定程度比你的能力和成绩更为重要。但是有很多人想方设法地去
钻制度的漏洞，专做些损人利己的事，比方出钱给ICC multiple filing。在此申明：
我不歧视那些通过ICC 申请的同胞们（理解需要留下找工作的心情），但是鄙视那些通
过ICC multiple filing的人。正是这种人糟蹋我们的正常工作的权利，我们的辛勤成
果。
