现在纽约地区审查官(或者 DMV 官员)没有起诉肇事者，其实不是他（她）的错，而是
因为纽约州市刑事案件的标准问题。不同于其它州，纽约的有关汽车杀人的法律比较特
殊：如果司机驾车杀人，只对酗酒或吸毒的司机起诉其“驾车杀人”罪或“凶杀”罪。
如果想起诉“过失杀人”罪，必须证明司机在肇事的时候是“罔顾后果”地在开车（
reckless driving）；这是一个比较难达到的标准；而在其它州“过失杀人”罪只需证
明肇事者和其他普通司机相比，开车时没有“合理谨慎”地开（fail to exercise
reasonable care），这是一个较低的标准。因此，地区审查官(或者 DMV 官员)在这个
案子上也是照章办事，无能为力。
那现在去 change.org 签名有可能让地区审查官改变不起诉的决定吗？答案是：几乎不
可能。美国三权分立。地区审查官属于行政权，法官（司法权）无法改变地区审查官或

那次事故发生在受害者开完party回家的路上，而这次事故受害者可是从图书馆回家。
我绝没有说开party就要活该被车撞，但USC是不是要一视同仁。USC的中国学生应该给
校方提个醒，如果他们一毛不拔的话。如果校方带头，捐款肯定也不会少。

现在纽约地区审查官(或者 DMV 官员)没有起诉肇事者，其实不是他（她）的错，而是
因为纽约州市刑事案件的标准问题。不同于其它州，纽约的有关汽车杀人的法律比较特
殊：如果司机驾车杀人，只对酗酒或吸毒的司机起诉其“驾车杀人”罪或“凶杀”罪。
如果想起诉“过失杀人”罪，必须证明司机在肇事的时候是“罔顾后果”地在开车（
reckless driving）；这是一个比较难达到的标准；而在其它州“过失杀人”罪只需证
明肇事者和其他普通司机相比，开车时没有“合理谨慎”地开（fail to exercise
reasonable care），这是一个较低的标准。因此，地区审查官(或者 DMV 官员)在这个
案子上也是照章办事，无能为力。
那现在去 change.org 签名有可能让地区审查官改变不起诉的决定吗？答案是：几乎不
可能。美国三权分立。地区审查官属于行政权，法官（司法权）无法改变地区审查官或
者 DMV 官员（行政权）正当行事其权利的决定。这在美国联邦法院有判决书做依托：
