关于这个withdraw 我研究了一下 Once the employment is terminated, the
employer is required to notify USCIS by sending a letter to withdraw the H1B
application. 好像USCIS规定公司在员工离职后要通知USCIS withdraw H1b 在网上看
到大多数在十月前transfer的case都是成功的 难道大部分公司都不withdraw？但是lay
off的时候 公司都会通知最后paycheck日期哪天会withdraw H1b 从这一点看来 大部
分公司应该都是会按照USCIS规定withdraw的

两个多月前，经版上考古，发现邮寄纽约申请旅游签证耗时少不到三周，多不过两月，
遂抱着侥幸心理，估计两个多月应该够了。谁知道最后还是亲自去领事馆跑一趟

看到版上各种问h1b批准后生效前transfer的帖子 有人说新h1b approve了就没问题了
也有人说旧公司withdraw就遭殃了
置顶说H-1B批准之后就可以transfer，不需等到生效。但是没提生效前原h1b withdraw
了会怎么样
想请教一下 h1b批准后transfer跳槽 新h1b approve了 旧公司在10/1前withdraw申请
USCIS会从第一份h1b track到新h1b 因为第一份h1b被withdraw了 新h1b即使已经
approve了也无效了吗？
律师的说法也没个定数 有说没问题有说不行的 不知道有没有人知道真实例子？

另外有人提到公司付了500刀secure default就可以在10月前withdraw 研究了一下只有

withdraw，但是USCIS 的Vermont Service Center效率十分低下（它家花了3个月时间
批H1,又花了3个月时间批withdraw，而通常都是两个月），直到上周，我才弄到正式的
withdraw通知。
然而，9月份的时候，SEVP已经assume我的H1即将生效，所以把SEVIS record改了，说
OPT 2011年9月30号失效。但既然现在H1B已经在7月29号withdraw了（正式文件上写的
是这个时间withdraw），所以我的OPT应该继续使用至明年一月份。学校的
international center已经同意递交申请改exp date
我的问题是，有没有大侠经历过这样的事情，SEVIS record改过来需要多久？还有就是
在SEVIS RECORD改过来之前，是否有authorization工作？现在这种情况能否申请H1或
者OPT extension？ |

1。一周内属于drop/add时间，drop掉的课程成绩单不显示，但要根据开课时间的长短
扣学费。
2。学期结束前一个月、在withdraw deadline之前退课，不需要教授签字，成绩单显示
为"W"，不影响GPA。
3。在withdraw deadline之后退课，需要教授签字同意给"W"，否则算"F"。
4。在退课后不满full-time的，不管什么情况withdraw课程，就算是有医院假条，也需
要告之国际办公室的DSO并经过他们批准。批准后DSO应该出具新的i-20，上面有"drop
below full time"的remark。否则DSO可以terminate你的I-20，也就是你f-1的合法身
份。
所以，不管如何mm最好都去国际办公室先了解一下情况，告诉办公室是教授强力建议你
withdraw的，必要时可以请教授写封简短的邮件证明一下。

她。

withdraw，只是找新医生做体检，用新的体检结果取代旧的？
看了下，好像没找到一个withdraw的方法。另外看到有律师说，如果485有问题，比如

以前H1B，有娃后转成H4边找新工作，七月份定了一个offer，新公司八月底file H1B
pp, 九月中一查被RFE了。
律师不告诉RFE的原因，说跟公司沟通。这周发了几封邮件问HR HM都没回音，结果接到
个电话说withdraw offer，final decision，因为公司内部律师认为H1B RFE可能要拖
几个月而且还不一定能批。。。（言下之意是找新人更快。。）
请问1，这种情况跟公司沟通还有戏吗？怎么说比较有效？

看了自己公司401K的说明书，没的选择，就是传统401K，不是roth 401K
1. 公司以50%的比例match，上限是工资的10%；换句话说就是工资的5%的profit
sharing。个人想法是，这个是应该全拿的。不知道有没有考虑错的地方？
2. 刚工作不久，所以可能过几年买房。如果可以用401K的钱作为downpay是最理想的，
这样可以直接用到matching的部分（vest 100% 要5年）。说明书提到了loan, 也提到
了hardship withdrawal（只要可以loan就不可能给），但是没有看到大家总是讨论的
10% penalty的early withdrawal。要是交个10%就能把自己本金+公司matching都拿出
来那还不错。如果loan，interest重复交税，又要还401K的loan，又要还mortgage，感
觉很奇葩。
3. 如果随时可以early withdrawal，这样想读个学位啊买个什么什么干嘛的都自由了

了工作，不过2008年9月28日我withdraw了H1B，学校也重新激活了我的OPT，2009年1月
我PhD录取了，F1时间延长到了2014年，不过这个期间，我转为了F2身份，现在F2身份
依然有效。
最近我找到了个新工作，可是公司没有移民律师，对移民也问题不懂，只是说如果我想
接受这个offer的话，希望我能尽快搞定工作身份，尽快去工作。他们不愿意去雇律师
，但是可以适当提供文件。
我想问的是，我现在可以从F2向H1B身份transfer吗？当时那个H1B被withdraw了，还能
有效吗？我和以前的律师谈过，他说还不是确定这个问题，这两天他会帮我研究。可是
我真的很着急。
当时为了保住OPT，是学校留学生办公室让我要立刻请求原雇主帮我withdraw H1B的，

2.东部地区分析化学的community school，技校也行，有吗？最下等是语言学校，纽约

3.gpa 不到3.0，不知道appeal的机会有多大?因为官方这么说，实际上很多不到3.0不
过每个人弱点不一样，他就想dismiss 最差的几个吧，不过的评差的标准有说头，比如
导师影响，或者别的因素，他不会正式的告诉我这些的。这个有appeal的空间吗？

现在准备从了其中一家。请问需要withdraw第三家公司的申请吗？他们家做事情不急不
慢的，onsite时，他们就说希望我可以半年后学业都结掉再去。（给了offer的两家都
希望我春学期先去上班。）可能人家本来就没特想招我～ 这种情况下需要withdraw吗？
如果withdraw的话，怎么说才不得罪他们？（以后不知道会不会再转战他们家呢～）他

发帖数: 26 | 44 1. GPA不到3.0， 我关心的是appeal dismiss和withdraw哪一个更能争取时间transfer
学校。都没有grace time吧？dismiss和withdraw对以后申请学校有影响吗？反正都是
会看gpa的，你withdraw了，看一眼也知道是因为gpa不够。我要申的不是特别好的，一
般的学校。我的是第一学期2.65，第二学期2.98，平均2.88
2.东部地区分析化学的community school，技校也行，有吗？最下等是语言学校，纽约
地区便宜的立刻拿I-20的是哪个呢？多少银？如果太贵了，不如回去重申，顺便探家了。
3.gpa 不到3.0，不知道appeal的机会有多大?因为官方这么说，实际上很多不到3.0不
过每个人弱点不一样，他就想dismiss 最差的几个吧，不过的评差的标准有说头，比如
导师影响，或者别的因素，他不会正式的告诉我这些的。这个有appeal的空间吗？

公司已经年初申请了h1b， 并抽中了。但是现在因为家庭原因， 不能去这家公司， 能
不能withdraw h1b ， 然后申请opt？ 能自己向移民局提出withdraw吗？ 还是必须通
过公司来办这个？ 公司的律师效率很低， 很担心因为他们耽误了opt的申请。 现在
百爪挠心， 万分着急，感谢有类似经历的童鞋分享经验。 谢谢了。 |

发帖数: 266 | 48 这些都是律师处理呀，律师也知道我的h4 pending，但是这个律师也没特别的处理，却
在h1申请之后在我问的情况下，才告诉我我应该withdraw,我稀里糊涂的听这个律师的
就这样办了。
我给USCIS打电话问，如果这种情况怎么办，USCIS说最好还是withdraw,否则h4的确可
能会overwrite h1. USCIS告诉我最好的办法是withdraw h4之后再去境外签证激活h1，
这样就不会被GAP影响到了。不过他们的话也不靠谱,有些奇怪，因为新的h1I-94也发给
我了，出境的意思不大。我现在不存在这个问题了，因为我的h4在h1之前其实在我h1申
请之前就批了，我只不过不知道，现在没有Gap了。 |

mm目前在东岸一间黑心FIRM工作..目前H1b已经批准
前阵子在有一间白人firm雇用了我并且会帮我处理签证转换的事情
他们目前把我的上班日设定在10月，mm最近想辞职把该考的考试考完顺便可以上班的时
候领bonus
只是如果现在走的话，估计现在黑心老闆肯定withdraw 那麼之后如果firm要帮我负责
转换的话问题大吗?
这个情况可能跟板上一种状况很像(h1b批准后生效前遭到lay off)
我的OPT到九月初..所以即使现在老闆去withdraw 我也不太担心

发帖数: 2881 | 50 我2008年拿到了H1B,我当时的OPT时间是02.2008至02.2009。可是当时2008年9月26日丢
了工作，不过2008年9月28日我withdraw了H1B，学校也重新激活了我的OPT，2009年1月
我PhD录取了，F1时间延长到了2014年，不过这个期间，我转为了F2身份，现在F2身份
依然有效。
最近我找到了个新工作，可是公司没有移民律师，对移民也问题不懂，只是说如果我想
接受这个offer的话，希望我能尽快搞定工作身份，尽快去工作。他们不愿意去雇律师
，但是可以适当提供文件。
我想问的是，我现在可以从F2向H1B身份transfer吗？当时那个H1B被withdraw了，还能
有效吗？我和以前的律师谈过，他说还不是确定这个问题，这两天他会帮我研究。可是
我真的很着急。
当时为了保住OPT，是学校留学生办公室让我要立刻请求原雇主帮我withdraw H1B的，
他们说，否则2008年10月1日我的H1B自动生效，而他们无法激活我的OPT的。 |
