w*********i 发帖数: 658 | 1 As the Code says,
Limitations on taxpayer's right to claim a refund:
A taxpayer may file a claim for a refund of an overpayment of tax within:
(1) 3 years from the time the return was filed or
(2) 2 years from the time the tax was paid, whichever period is the last
to expire.
My question is:
Is the filing date the tax return due date (April 15)?
If my filing date is April 15, 2006 and the tax was paid on Feb 12, 2007.
What is the expiration date for refund claim? Feb 12, 2009 OR April 15, 2009?
Thanks. | h******n 发帖数: 221 | 2 It is the later of

(2) 2 years from the time the tax was paid,
In your case, it is 04/15/2009 | w*********i 发帖数: 658 | 3 Thanks. What is the relationship among the return was filed, the time the
tax paid, and the tax return due date?
【在 h******n 的大作中提到】 : It is the later of : (1) 3 years from the time the return was filed or : (2) 2 years from the time the tax was paid, : In your case, it is 04/15/2009
| h******n 发帖数: 221 | 4 The filing date is the date that you sent your tax forms to IRS which
usually is earlier than due date (04/15 each year).
The due date is 04/15 each year.
The tax paid date, I guess is the date your check is cashed by IRS or your
bank account was withdrawn by the IRS. I am no sure though. |
