背景资料：
Plaintiffs Abigail Noel Fisher and Rachel Multer Michalewicz applied to the
University of Texas at Austin in 2008 and were denied admission. The two
women, both white, filed suit, alleging that the University had
discriminated against them on the basis of their race in violation of the
Equal Protection Clause of the Fourteenth Amendment.[2] The University of
Texas at Austin accepts students in the top 10% of each Texas high school's
graduating class, regardless of their race, under its Top Ten Percent plan.
Eighty-one percent of 2008's freshman class were admitted under the plan.[3]
Fisher fell short of the top 10% threshold, and was thus considered with a
pool of students where talents, leadership qualities and family
circumstances as well as race were considered as part of the admissions
process.[4][5] Fisher had a grade point average of 3.59 (adjusted to 4.0
scale)[6] and was in the top 12 percent of her class at Stephen F. Austin
High School.[6] She scored 1180 on her SAT;[6] the 25th and 75th percentiles
of the incoming class at UT-Austin were 1120 and 1370.[6] She was involved
in the orchestra, math competitions and volunteered at Habitat for Humanity.
[6] Fisher enrolled at Louisiana State University, where she was in her
final year as an undergraduate in 2012.[1][7] She is represented by the law
firm Wiley Rein.[8]
Michalewicz had a 3.87 GPA[9] and was ranked in the top 10.14 percent of her
class at Jack C. Hays High School.[9] She scored 1290 on her SAT.[9] She
was involved in the marching, concert and jazz bands;[9] she volunteered
with the St. Vincent DePaul Food Bank and participated in a fishing event
for handicapped children.[9] Michalewicz withdrew from the case in 2011,
leaving Fisher as the sole plaintiff. As of 2012, Michalewicz was attending
law school at Southern Methodist University.[4][7]
