发帖数: 1274 | 1 事故发生在大约1个月前，我的车被追尾，肇事者是两个开pickup的美国人。事情经过
是这样的
（保证属实）：
限速30迈的two-lane， 我后面紧跟了一辆pickup，但我没注意他们距离我有多远，应
该是很近。在快到一个blinking traffic lights时，我突然看到前方有两个女孩在路中间准
备过斑马线，因为旁边有Yield的标志，我紧急刹车，从刹车到停下（在斑马线之前）大约有10
米的距离。后面的车没及时刹住，他也想往右边躲开不过没成，就这样把我追尾了，警察1分
钟后过来处理了。
由于当时心思都在车上了，我刚买了一个月的车，rear bumper和trunk被撞了个稀巴烂
，警察在问肇事者和那辆个女孩时，我也没注意听，不过我听见那两个老美向警察争辩说我突
然停下他们才刹不住装上的，我当即说我不是突然停住，而是看到有人要过马路才刹车的，警
察好像曾走过来对我说这完全是他们的责任，于是我就没很注意那两个老美和警察后面的对话
，不过最后警察好像没有给他们tickets，只交给我和他们两张卡片，说下周可以去buycrash
网站上查事故报告。我一头雾水，但是基于前面警察曾告诉我使他们的责任了，再加上还有目
击证人，于是就开走了。
结果接下来的一个月让我非常恼火，主要是他们的保险公司态度非常差（一个三州联保
的小保险公司），而且他们一开始要求我去本地一个根本没听说过的修理店做estimate，但我
要求到另一家口碑很好的bodyshop，他们也同意了。那家bodyshop按照全新的bumper和trunk
给了7000的报价（警局的事故报告上给的维修估价是5000-10000）。不过我知道实际上大部分
保险公司会要求用旧零件维修的。
最让我生气的是，这家保险公司一直声称没有收到警局的事故报告，也没有和他们的
insurer联系上，最后我去警局拿了报告发给他们，又给撞我车的那个人打了无数电话，他才同
意和保险公司联系。（无数电话大部分被转成留言，保险公司也是同样的说话，我很怀疑肇事
者不愿意赔偿）。
然后今天收到保险公司的电话，说他们的insurer声称是我紧急停车而造成他撞我的事
故，只愿意陪一半，我说警局报告上很清楚，造成circumstances全部责任在他而不是我，但是
保险公司还争辩说证人的描述中也有我“suddenly stop”的话，所有不愿意全部赔偿。他们最
后只给我大概2000多的赔偿，这连事故报告上写的least estimate一半都不到。
我是第一次被撞然后也是第一次遇到这种不认账的情况，请问大家这种情况我真的有责
任么？
我准备和那个肇事者再打个电话，如果他确认还是argue的话，我是否需要打官司解决
呢？毕竟这件事已经被拖了一个月，我不想再纠缠下去，还有如果打官司赢面有多大？大概会
多长时间？如果打官司的话，保险公司是否就不再支付任何维修费用了？谢谢。 |

似的经验么？

还有，我如果起诉，是起诉肇事者还是他们的保险公司呢？

Google small claim court + your state/county name
also don't only sue insurance company, sue the driver, or driver+insurance
company

pretty much throw it away, just like insurance companies do when it's
not their favor.
if you are not satisfied with the result, small claims court.
check your state's small claims court limit on amount of $ you can sue
for.

hours on research, paper work and fighting with insurance company. Or you
can get a lawyer and do nothing other than going to the doctor/therapy and
usually get more money into your pocket. |

or you can pay them $200/hour. they can easily charge you 20~40 hours.
with bodily injury, they sue for 3 x medical bill. so hospital gets their
payment, lawyer takes their share, and you get the remining 1/3. this 1/3
is almost always a lot more than what you can get by dealing with it
yourself

can only argue for the loss of my property and maybe the inconvenience which
caused me during the last one month.
I will probably thinking of small claim court, but I think I need collect
evidence first. I was so unlucky to wast such a long time on this

bring photos, witness (passengers in your car), police report can be as
extra but not necessary.

the two pederstrian who were trying to cross the rd are the only witnesses
except myself.

an estimate of over $7000. Do I need to hair an atterney then?

you better hire a lawyer if that's the case, because in small caims
court, no lawyer is allowed inside the court room so you are on even
ground with the insurance company.
but now the other side can have a lawyer to represent them, you'll be at
great disadvantage if you don't.
I suggest you go see a accident lawyer first. they'll take care of your
property damage case, also free of charge if you have a bodily injury
case with them.
even if you decided not to file for bodily injury, at least you may get
some free advice from lawyers

case
one of my own court experience was also for somebody rear ended into my
car. I won the case easily in small claims, the other side appealed, and
it was Superior court for the appeal. the car owner had insurance's lawyer
with them for the appeal.
but I still won the appeal again just by laying out the facts clearly. I
even got a higher reimbursement for missed wages for myself and my witness
(passenger in my car) for the appeal court date
