I. file a claim with the other driver's insurance company directly. you don'
t pay
anything
or
II. file a claim with Your Own insurance company if you have full coverage,
then
you have to pay deductible first because you are technically filing a claim
against your own insurance. then if it's determined it's not your fault,
your ins
company will get all the money back and refund your deductible.
On fixing the car, you have 2 options:
A. get cash - if you do NOT want to fix the car or want to fix it cheap and
pocket the differece, get 3 free estimates from 3 different body shops, fax
them
to the insurance company and ask for as much as possible
or
B. get the car fixed - send your car to good bodyshop, ask them to bill the
insurance directly. Usually insurance company recommended bodyshop are good;
avoid dealer because most dealers do not do body work, they tow your car to
a
body shop nearby and charge you $2000 extra.
Call other party's insurance. demand car rental reimbursement, starting from
the
day of the accident until the proprety damage claim is closed.
get a lawyer if you want to claim bodily injury. you can spend dozens of
hours on
research, paper work and fighting with insurance company. Or you can get a
lawyer
and do nothing other than going to the doctor/therapy and usually get more
money
into your pocket.
