你看看FB上再声讨的有几个是华人？有几个名字是传统的大陆名字？
白人虽然傻，但是人家名族是有核心价值的，family value还是知道的，
我们呢？不把同袍踩下去就不错了。

发帖数: 1998 | 5 不要太悲愤了。我目前还是对这个案子持乐观态度的。刑事方面肯定不会有问题。惟一
可能有麻烦的就是民事方面。人家毕竟瘫了，从法理上，赔偿是免不了的。就算是破财
消灾吧。
就怕会不会弄出天价赔偿，到让路虎哥破产的程度。
不过现在还没走到那一步，相信真到那一步了，大家捐钱出力也不会少的。
阴阳怪气的人哪里都有，而且这些人大多是attention whore，所以声音会喊得比别人
都大。看上去好像会让人很沮丧。但正常思维的人应该还是占多数的。

但的确目前没有证据说那个受伤的直接参与了打砸抢。sigh
希望那几个警员中可以提供一些有用的口供吧。但是估计悬。那几个警员因为这件事渎
职几乎职位不保。不容易主动说出很多有利于路虎的证词。

Lien is direct cause of the damage but not the proximate cause of the damage
. There was no duty owed, and therefore there is no duty breached.
Tort Law.
Verdict: not liable.

others and do not put others in further harm.
For example, when noticing a group of children or geese crossing a street, a
reasonable driver would stop his vehicle and wait for the children/geese to
finish the dangerous journey before resuming his own driving action.
Similarly, one could argue that there is a default duty for any driver, who
is behind the wheel, that when he or she starts a vehicle, he or she has to
make sure that there is no person or animal immediately in front of the
vehicle's driving path. If the driver sees a person in plain sight and still
drives over that person, the driver is either intentional or negligent or
non-negligent. Additionally, one could argue that even if a driver intends
to drive over another person in front of the vehicle, the driver at least
should flash the light, hunk the horn, or shout loudly to let the other know
his intention to drive. Thus, there is still genuine issue of material fact
for the finders to decide. The court would have to set the reasonable
standard and the driver's action would be analyzed against that bench mark.
Life is precious, for a burglar or a biker or a driver. When pulling the
trigger to let go a bullet into human flesh or starting a 2000 lb+ monster
over another's spine or hitting a car window with a helmet or bare hands,
one has to go over some basic humanity checking process and make a sensible
conclusion thereafter. Human is the only creature in the world who creates
language to humiliate fellow humans and who invents machines to kill fellow
humans. Whether you call it innovation or destruction, a threshold question
has to be asked and answered before an action is taken using that manmade
machine.
I would not jump quickly to the conclusion that the proximate cause of
driving over a human body is not the driver's action. The driver started a
vehicle, set the steering wheel to a specific direction, and pressed on the
gas pedal with a steady force. It is obvious that who was in control of the
vehicle at the time. This is a separate issue from whether it was reasonable
for the driver to do so. There is no denying that who drove the vehicle
that day. It was not God for sure.
As to the driving without license issue, the purpose of that law is to
protect people from being hit by unqualified drivers in the road. A kid
might not have a driver's license. But no driver would use that as an excuse
to commit hit and run over the kid in the street.
