My story:
Recently, I moved to a new workplace. Most of the colleagues are nice and
fine. But I feel one of them (not chinese)is rude and always gives shitface
and sometimes yelled to my Chinese colleagues. He is a very emotional person
. However, during the past month, I didn't see he ever yelled at colleauges
with other nationalities.
After counseling with my senior Chinese colleague, I was told that if I
believe what he does is a harrasment or racism, I should keep record and
report to department.
My questions:
1.How to deal with this situation in a legal and effective way?
2.How to keep the record of his behavior?
3.Is there any guideline that I can use for reference?
Any suggestions or information are welcomed. Thank you in advance!

1. Try to get her unprofessional conduct on email
2. Talk to her separately, try to understand her point of view. It's better
to make friends than enemies
3. Make alliance with other co-workers. figure out the rules of the game at
your company. Figure out promotion, raises and references.
4. Learn to be cool even under pressure. Know that even if you are treated
with injustice, you are not alone and have a community behind you. We are
hoping to create a
loose mentoring and referral network for Chinese-American Professionals,
Businesses and Politicians.
5. The tool of last resort to use is HR and legal. Hopefully we could
get someone professional to answer.

牢记一点,workplace harassment或racial discrimination的界定不是施害人是否有
主观意愿因你的种族,性别等骚扰你,而是受害人的感受,只要你觉得offended by
his words/acts,你可以,1,通知HR,公司应当有anti-harassment policy,HR
有义务员工提供有关培训并说明员工的义务和权利。可以先联系HR让他们出面解决,2
,起诉racial discrimination。如果他说话时有证人当然好,不过你的回忆和证词也
是有效的。很多州不允许对方不知情而录音录像作为呈堂证供,但给HR作证据应该可
以。

Thanks for these informative tips!!
I found out there are harrasment policy and complaint procedures on our HR
webstie. HR is for sure the best way to deal with this.

very helpful.
my plan:
1. calm down. I am a little grouchy recently.
2. talk to him and get to know him at happy hour time if possible. I was
just shocked when he yelled at my other chinsese colleagues on my first few
days. That made me have preconceived opinion about him perhaps.
3. Read HR policy and statement.
