什么是"standing"?来看看下面的解释:
"In law, standing or locus standi is the term for the ability of a party to
demonstrate to the court sufficient connection to and harm from the law or
action challenged to support that party's participation in the case. In the
United States, the current doctrine is that a person cannot bring a suit
challenging the constitutionality of a law unless the plaintiff can
demonstrate that the plaintiff is (or will imminently be) harmed by the law.
Otherwise, the court will rule that the plaintiff "lacks standing" to bring
the suit, and will dismiss the case without considering the merits of the
claim of unconstitutionality. To have a court declare a law unconstitutional

不是!! 前年没拿到,去年没拿到,可是今年或明年你可以拿到.IT IS ONLY A MATTER OF
TIME.
HOWEVER, 长年的等待给广大的除WSN,WSNV外的群众带来了多大的精神痛苦,这个是无法
替代的,损失是巨大的.你知,我知,它法庭人员不知,它沟僻律师不知.LAWSUIT,一定要充
分强调这个.不能光从法律的角度来讲,它是违法了,你站理,那又怎么着?
所以,索赔,要就要大的.什么EAD,AP,RECAP,这些都不是原告提出来的.是被告提出来作
为谈判的筹码的.
所以我说那律师的分析根本就是本末倒置.
至于怎样夸大咱们的精神创伤,量化它,使法庭能站在咱们一边,坚决地共同讨伐DO-S,I-
NS,咱这"秋菊打官司"才有希望.
退一步讲,LOST IS LOST,但不能总让咱LOST.今次打官司目的最最实际的还是要求D-OS
加强对名额使用的监督机制,防止再次出现名额浪费;如果,再犯,应该有怎么样的补救及
惩罚措施等等.

要求法院驳回，没有给counteroffer？
大概问了一下，要求法院判决政府recapture visa,提供免费EAD/AP，相当于要求司法
干预行政，三权分立体制下，其难度比要求国家赔款要大不少。但我不知道上诉庭我们
能不能改claim？
我同意你的观点：钱砸下去要听个响。据说应诉的律师费和相应的赔款都是从行政拨款
（budget)里出，这里用了其他地方就少了。告了，咱们就尽可能用最合理的成本，对
对方造成最大的伤害，别费了劲儿没比划两下就被对方化解了。
我站着说话不腰疼的给老猪提个建议：EB3 case的team里是不是争取吸收一两个学法律
的？有时候有人说话不好听，未必是坏事。兼听则明么。 | c********k

痒痒...
不改CLAIM,我看不行.改CLAIM,上诉庭看不知行不行.俺不是搞法律的.俺搞逻辑的.非常
希望能帮大家走出困境.
TEAM里必须要有学法律的懂法律的.老猪不要怕人,要能纳人
EB2C也该琢磨琢磨如何配合EB3C案子或独立立新案子.说句题外话,当前EBI与EBC 排期
捆绑,是对所有ZGR的蔑视.
