Dear Stakeholder,
U.S. Citizenship and Immigration Services (USCIS) invites you to participate
in a stakeholder engagement at the Nebraska Service Center on Tuesday, July
18, 2017, from 8:30 a.m. to 3:00 p.m. (Central).
During this engagement, USCIS representatives will provide an overview of
our work on employment, humanitarian, family, business, and deferred action
for childhood arrivals (DACA) cases, and the production of travel and
employment authorization documents. There will also be a lunchtime
presentation on Form I-9, E-Verify, employee rights, and the SAVE program.
To register for this event, please follow the steps below:
Email [email protected] no later than Friday, June 16.
Reference “NSC Open House RSVP” in the subject line.
Please include your full name and, if applicable, the organization you
represent.
Once your registration is processed, you will receive a confirmation email.
The final agenda and directions to the Nebraska Service Center will be
provided before the event. On the day of the open house, please bring a
government-issued photo identification and plan to arrive at least 30
minutes early in order to pass through security.

Part 1. 485 case assigning 及BC相关
1. Case 什么时候Assign 给adjudicator， 有什么先决条件，或者Assigning 的
order吗（比如RD， FP date， BC clear date etc）
A: case assign to adjudicator upon reception。 但是注意，一般application是
file 到lockbox，等过了mailroom的基本检查，和data entry 环节，application才会
转到service center。其中有一段delay。 然后BC 开始。BC 包括FP相关的check 和其
他的BC check（没有详细列举内容）和 other security check（也没有列举）。 FP相
关的check， 在FP打的当天就送到FBI去request check。一般2-4 hours later，结果
就可以返回供adjudicator 查看。不过service center 内部有两套 data system，
adjudicator 可以review的，和T1 T2 service people可以看到的是不一样的system，
而且T1 T2 能看到的内容有delay。只有相关的BC做完了，adjudicator才会开始
review case。甚至在485 批准当天，也有一些security check要完成，才能做决定。
2. 对于Con-file，NSC、TSC 有different procedure， 比如TSC要先做完complete
BC，再review 140+485， 而NSC好像是140有相关的BC，485又有另外的BC。请问是这
样吗？ 两个center有计划使用统一的procedure吗
A： TSC 只有一个team，审查所有的140+485，所有他们先等待所有的BC clear了，再
一起审140+485 （笔者注： 这说明TSC的con-file 的140+485完全可能就是一个
adjudicator在review）； 而NSC是有两个teams，各自审140 和 485， 所以140需要的
BC做完了，就可以review 140，然后485 team开始485相关的BC，等BC clear了，再
review 485. 虽然是两个组，但是大家“work closely”。
NSC已经多年使用两个team，不打算学习TSC。 TSC也表示会继续他们现在的procedure。
Part 2. RFE 相关
3. NSC 是提前发RFE吗？为什么？
A： NSC 和DoS每个月都有高层会议，会上对下个月的visa quota和可能进展有通报。
NSC据此提前查看可能要进展到case，发RFE。这样，等这些PD current，如果RFE和
supporting documents 就位，adjudicator就可以开始审批。而且NSC现在“push for
485 at the beginning of the month”,然后这些adjudicator再去审查其他的
category 的案子。
4. 关于体检RFE有新的政策，以前的体检不延期，申请人可以自己提前做体检自己
交新的体检表吗
Ａ：不要自己补交材料。等ＲＦＥ。而且等申请人排期current了之后，请等15天再
file SRMT inquiry。
5. 我们注意到NSC可能发各种RFE，请解释一下
A：Adjudicator一般发这些RFE： G-325A， proof of lawful admission, job offer
letter, marriage certificate, birth/adoption certificate, I-693. 因为
application首先到达lockbox，mailroom在分拣的时候，可能把申请人原来提交的资料
放到其他application去了（比如I-765, I-131），或者搞丢了。甚至有可能一下材料
复印的不清楚，现在就会要求补。他们要求adjudicator发RFE的时候，一次性把缺的，
需要的材料都列出来，不要来来回回发好几轮RFE。
Part 3. Online Status 相关
6. Online status经常好久没有变化，让人不知道case 的进展到底如何，比如FP相
关check是否完成，case 是否Assign了。Online status还会从acceptance直接变化到
card production。 请问是否有计划增加一些新的中间步骤的status？
A：Acceptance是lockbox 收件后的status。如果case assign了，adjudicator可能开
始看案子的当天就处理完了，所以就直接到最后一步了。如果中间有RFE的话，会有一
些status变化。目前没有计划增加中间步骤。
Part 4. Pre-adjudicate 和adjudicate 相关
7. 如果485 交了，但是排期倒退了，case会pre-adjudicate 吗？
A： 回答。Case 收到就assign 给adjudicator。一旦相应的BC clear了，adjudicator
就会预审，但是因为visa not available，所以没有办法完成处理。预审完了，Case会
被放回相应的架子上，等排期C 了再拿出来完成最终审理
8. 每个月service center 怎么知道有多少quota，怎么知道该完成多少case呢
A：主要根据VB的排期。凡是排期之内的case，材料都齐了（比如RFE回复了），485小
组就全部都审，审好了就递交给DoS。DoS在控制具体发放多少卡。（笔者注：当时485
supervisor还举了一个例，比如下个月根据排期，有1000个cases可以审理，那么NSC都
可以审理完，递给DoS，哪怕最后DoS只发200个卡）。
9. 关于EB23 transfer、relink的补充回答:
如果transfer request 485 到 排期current的类别，那么485 会被继续处理。如果一
个pending的485，在两个categories 都current了，那么USCIS（可能）会发RFE，要求
申请人自己选择一个category作为485的basis。当然，申请人也可以自己发transfer
request，选择一个category作为basis
Part 5. EB interview
10. EB interview 是否是random的？
A： 不是random的。因为service center 本身不能interview 申请人，但是有些案子
又需要interview，所以service center和field office达成了协议，只有“mandatory
or substantial benefit for adjudication” 的情况下，才会把案子转到field
office。相关的条件大致有：1）有criminal record或者其他一些必须面试的record，
这样申请人可以有机会一条一条的解释不利的record。 2）递交485之前才结婚，没有
小孩的couple。
面试可能当场通过，但是跟service center一样，也受visa availability限制，不一
定能当时就拿到卡。
Part 6 其他
11. EB3 downgrade 后，485的preference classification还是EB2， 需要改正吗？
A：需要。可以联系USCIS representative来改正。
12. 485 申请package是否还是每个application要2 张照片？
A： 是的。每个申请2张。如果485 + 765 + 131， 请交6张。 | r*******2
