发帖数: 196 | 1 我申请EB1B, 律师 claim 了4项，我想只claim 3 项，想问问大家知不知道这种情况最
后谁说了算？
我大概情况如下
1）15 篇文章（6篇英文1作，if 3-5。）
2）9个杂志的reviewer,共review了36篇文章。杂志是一般杂志，if 2-4。
4）15 篇会议文章 （7-8一作）
6）一个pending的专利， 一个book charpter
今天看了律师给我写的EB1B petition letter.除了claim常见的
1. scholarly contribution; 2. scholarly articles; 3.reviewer
外还claim 了 第4项：Published material in professional journals written by
others about the alien’s work.
证据是 3 -4 篇别人的paper里对我工作的评价；我文章的citation总共89，但
其实independent citation 的只有27.是我的弱项。我不想claim.其实律师还给我
claim了membership，经我反对，已经去掉了 |

Are they reviews or quotations in research papers? Be careful if the latter

But this criterion is much better than others. You need something to prove
"Outstanding".
The 3 criteria you planned are plain; almost everyone can do that.
"我文章的citation总共89，但其实independent citation 的只有27.是我的弱项"
Then use the number 89, not 27.
Citation itself is not a claim, but an evidence for contribution/authorship. |

The 2 reviews, are they focused on your work, at least one of their foci?
"Perspectives" of Science and "News and Views" of Nature are typically such
reviews.
IMO, lesser ones would do too, such as a news piece in professional journals
. But you'll need more of these. |

category but we can put an argument using the same evidence from one
category and add it to another. ”

The lawyer for EB1b (the lawyer of company) usually does not have as much
experience as the lawyer for Eb1a. They are only good at the things like H1b
and Perm, so do not expect too much from them.

不一样，但只要过了也行。

下，还是按照自己觉得比较comfortable的方式申请吧 |

Citation做媒体报道证据的方式早已不能用了。
媒体报道要求两点：
1、主流媒体，有一定的发行量和读者群；
2、报道内容为您或您在相关领域中的研究工作。
Citation既不是报道您也不是报道您的工作。 |

，最后还是按lawyer的方式去办，材料已经用PP递出去了。让laywer 个机会，我估计
只是耽误1个月的时间。
我现在准备RFE了。 claim媒体报导肯定是不行， RFE的时候我可不可以完全放弃对媒
体报导的辩护, 然后只 辩护 1. scholarly contribution; 2. scholarly articles;
3.reviewer。 希望大家多提建议。 |
