我的OPT是在今年的6月3号到期，按照算60天话，严格意义上是8月1号要离开美国。但
是呢我婚还没有结。。。准备打算马上去iowa登记。。最晚在7月16号。毕竟人在
houston。。BF要请一个星期的假也不是那么容易。我网上也查了一下好想说marriage
的话无所谓visa或者F-1到不到期。在结婚完和8月1号期间我是不是应
该马上把130和485给交了。。。如果交了之后我的身份怎么办？是不是要去某一个地方
领一个证来说明我还能正式留在美国？
还有是我有SSN号，什么时候可以正式工作呢？有工作的offer但是和我master专业风马
牛不相及

不确定结婚之后是不是可以一直待在美国，换个探亲签证回来？
至于工作，有offer，没有opt,h1b应该也不行吧。 |

你的身份问题，想什么时候交绿卡申请都可以，你在申请绿卡之前哪怕黑了１０年，也
可以洗白。

一个网站上问了一下。。但是有好几种说法。。大家帮忙看下？
1.You are still within the 60 days grace period under your F-1 status, which
means you are considered legally "in status" in the US. Now that DOMA is
down, your same sex partner may file an immigrant petition on your behalf.
You are still responsible for showing a bona-fide relationship just like any
other heterosexual couple. It's always best to hire an attorney to guide
you through the process and most especially since this is a new policy which
may require some legal arguments to be made at the initial filing.
2. What is your partner's immigration status? Your spouse must be a U.S.
citizen if you want to adjust your status in the U.S., you will have to
provide evidence of bona fide marriage.
3 Because the DOMA no longer exist, you will be able to adjust status as a
spouse of USC in the United States.
4 DOMA or not you have to be always concerned about your immigration status.
Supreme only found article 3 of DOMA unconstitutional, it did not do mor
than that. In any way, it did not grant immigration amnesty to all gay
nonimmigrants or non-citizens in the USA. if you question has to do with
whether you would be able to adjust on account of your marriage, not now. We
need to see when DSH would change its regulations to include all people for
purposes of immigration benefits regardless of their sexual orientation.
5 Even for a hetero marriage you would need to worry about immigration
status. Yes, you need to do something to stay in status, see a lawyer.

ADJUSTMENT OF STATUS没有问题。但是我不肯定，你如果身份过期了，能不能及时拿到
EAD工作（一般３个月），建议你仔细看看文学城PIJIANG老师的博客和到文学城移民论

老师，另外等这个星期移民局关于同性伴侣移民的GUIDELINE，我相信同性伴侣和异性
伴侣的规则是一样的。

专业，而且多年如一日有问笔答，我还没看到在移民论坛有哪个问题没回答的，这样的

一般来说，同学们都会很小心地保持自己的合法身份。如果有身份问题，只要不超过
180 天，其 I-485 批准也不会受阻。但是老师要强调的一点，就是递交 I-485 时，申
请人当前身份必须合法 (a lawful nonimmigrant status).
如果申请人在递交 I-485 时，既没有合法身份也不是合法停留（详细讨论见“合法身
份”与“合法停留”一文），即使其身份违例不超出 180 天，I-485 也是断不能被批
准的。

expires. In the worst case, take a class in a community school which gives
you I20 to keep your student F1 status. You should be
okay once immigration application is officially received.You shall get an
official letter to confirm your application is received on file.Good luck on

申请EAD,(这是让你合法工作的) advance parol (这是返美证)
批下来之前不要工作，不要出境。一般三四个月就批下来了。
