GLAD的律师很清楚地表示，即使DOMA被最高法院推翻，Prop8还要慢慢地走它的上诉之
路。（除非有全民投票或其他的方法）
“Prop8是一起婚姻案，它是讲人们在州里被剥夺了结婚权；我们的案件是在州一级已
经被承认结婚的人在联邦一级也得到承认。”Bonuato说，“我们的原告们已经结婚了
。”
但是LGAD的律师说这并不会损害Prop8案。现在想要联邦法官对Prop8作出相似的决定--

派来的奸细，假装为DOMA辩护实际上是为以后推翻DOMA扫除障碍，National

problem of DOMA is trying to drive a wedge between the cultural right, and
the federalist right, while the former is strictly anti-gay, the latter
actually recognizes and respects state sovereignty. But again, on issues

奧巴馬要求DOJ拒絕為DOMA辯護就成了維護DOMA的高級黑。
但有一點我也不很同意。
如果說高院以微弱的比分認為既然都沒有什么好爭議的
“ no case or controversy"
也就是說高院的態度是沒有什么可立案的，不了了之，
那么Windsor v US 這個案件的最終裁決方就應該是聯邦第二巡回法院。
第二巡回法院裁定DOMA sec 3 違憲。
既然高院認為不再有爭議，那么這個聯邦法院的最終裁決應該有效。
DOMA sec 3 還是應被認定違憲。
至于到底應該有多大范圍的影響。。。
我也不清楚～～～
如果最高法院這次以這種方式結束，
就真的讓老百姓大跌眼鏡。
雖然說高院秉持不受民意驅使的政策，
但關鍵時刻總還是有點guts的，
否則怎么對得起200多年前馬歇爾大法官，
孤軍奮戰為最高法院確立的司法審核權。
Kennedy并不見得保守，
在boyscot 那個排除gay的案子里頭，
因為涉及第一修正案，所以裁決偏向保守，
因為法官們把第一修正案看得無比重要，
認為言論自由，宗教，結社自由是立國之本。

２－３年会废除，在QUEERNEWS被批不用等那么久。
立法废除暂时不会有大的进展，因为今年是选举年，而且众议院共和党占多数。但是２
０１６年之前不是没有可能，民主党夺回众议院不是一点都没有可能，连HOUSE
SPEAKER john boehner 都承认有１／３的可能，即使共和党占多数，也不是没可能，
NY州就是一例。４年半是很长的时间，民意变化太快了，共和党会逐渐放弃反同立场的
，因为绝大多数的民主党人支持我们，其实我们只需要一小部分共和党的支持就行了。
OBAMA也绝对有INTENTION废除DOMA。认为政治家完全是投机，根本不想做事，太
CYNICAL了。投机为了什么？选票为了什么？还不是为了做事。OBAMA在第一任里废除了
DADT，签署了HATE CRIMES BILL，让同性伴侣有了医院探视权，给予联邦雇员同性伴侣
伴侣福利，停止为DOMA辩护，宣布支持同性婚姻，就剩下通过ENDA和废除DOMA了。现在

大概就是一家在线报税公司因为报税欺诈被起诉，公司的CEO和CFO被列为共同起诉对象
。控方无法用CEO和他老婆的电话录音作为证据，因为所谓的spousal privilege，不幸
的是CFO是个gay，在vermont注册结婚的，然后他和他老公的电话录音能不能受spousal
privilege保护就是一个有争议的问题——DOMA
这时候，一个牛B大律师乱入了，要求主导CFO的辩护，原因是牛B大律师的gay哥哥临死
前的遗愿就是打倒DOMA!(顺便说一句，他哥死于AIDS)
牛B大律师希望把这个案子办成一个将来在反DOMA诉讼过程中可以援引的案例（我的理
解）
不幸的是，一轮关于同性恋婚姻和异性恋婚姻谁更混乱的交锋之后，法官还是判CFO
gay couple不受spousal privilege的保护，援引DOMA
然后，主角发现牛B大律师开始把CFO往沟里带——他希望CFO输掉这场官司，然后上诉
到最高法院……
