The Case: In 2008, Karen Golinski, an employee of the Ninth Circuit Court of
Appeals, requested that her wife be added to her family health insurance
plan. When the US Office of Personnel Management (OPM) refused, citing DOMA,
Golinski filed a lawsuit in the Ninth U.S. Circuit. She won her case, but
the OPM refused to abide by the order. Golinski eventually sued again in
order to force the OPM to comply with the decision.

所以如果能先维持合法身份，还是要尽量维持合法身份，哪怕花一点钱。假结婚不能考
虑。 |

交税的问题应该就更没有悬念了，就算12月31日结婚，全年收入也都算married。明年
年中废除doma的话，2013年的所得税几乎肯定是可以占点便宜的了（除非收入相当） |

Prop 8 的判决倒是有很多种可能, 但broad ruling的可能几乎为零. 庭辩之后学习了
不少评论, 我觉得最大的可能是以上诉方缺乏standing为由dismiss. 这样, 下级法院
的判决依然有效, Prop 8被推翻, 但只限于加州.

broad ruling, 这是重大利好.
因为如果以state rights为法律基础, 那以后就很难要求联邦法院废除像阿拉巴马州的
宪法修正案. 但现在是以第五修正案的equal liberty原则为法律基础, 这就为将来的
诉讼提供了先例和法律依据. |

landmark case了，堪比60年代的种族隔离的案子了，supreme court不会这么没有guts
的，有几位大法官正想跃跃欲试地青史留名呢，这么几十年一遇的好机会，大法官们又

我比較同意這個老頭的分析。
加州那個案子很可能會局限在加州，
Windsor的案子會把DOMA sec 3廢掉。
以前也說過，Sec 2 和Sec 3 是兩個沖突的條款，
一個講州權，一個大聯邦主義，
自由派法官至少四個會認為sec 3 違反平權原則，
肯尼迪就算不講平權原則，
可能會認為第三條大聯邦主義管得太寬，且與sec 2 沖突，廢之。
剩下四個人愛干嘛干嘛，
寫出多么令人驚艷的反對意見都無所謂了。
反正都會是歷史大潮拍在岸邊的垃圾。 |

要结婚的了，这还只是我自己直接认识的，这5对里，其中有4对是因为要解决绿卡问题
而需要尽快结婚的；另外还有我认识的、但是今天没有和我联系的、我肯定他们也在考
虑结婚解决绿卡问题的，还有2-3对。大概算了算，在美华人同志伴侣，绝大部分（是
的，绝大部分），在今天以前，都因为这个DOMA而丧失了靠婚姻办绿卡的权利。 |

起来，真奇怪。。。虽说当时结了不能立马移民，可是这也显得太功利了吧。
反正我和ld在加州2008年合法第一天就去领证了。今年本来还盼着五周年anniversary
的时候有好消息呢。。。
