我们offer$275K。 然后我们的offer被送给银行，seller还要求我们交了$1000
earnest money。 今天上午agent发信说银行的counter来了，是原来的listing price
， $299K; 还说同时还有另一个offer on the table， closer to the listing price
；我们还没来的急反应， 下午agent又发信说seller决定go with the other offer,
说已经cancel了我们的offer。
我的问题是，我们的offer送了银行，还交了earnest money，是不是就是银行和我们之
间的事了。怎么seller又跳出来cancel了我们的offer呢？先谢谢大家解惑。 |

seller是在任何时候都可以不要你的offer的，没有办法的

发帖数: 420 | 5 Agent说是seller cancel了我们的offer，因为本来我们的offer已经被seller接受了，
签了contract送交bank了。当初seller要求我们交earnest money的时候，还说不管我
们和银行能不能达成协议，希望我们 be serious。所以我们二话没说，就写了一张$
1000的支票寄给了title company。 怎么现在seller能出尔反尔，earnst money对他们
一点约束也没有呢。下面是我刚刚google到的：
"From a buyer's point of view, earnest money along with a contract indicates
that he or she really does intend to buy the house. Once a contract has
been signed, the seller isn't supposed to sell the house to someone else,
but the seller might back out if a better deal comes up, even with the risk
of potential penalties. When earnest money is involved, backing out becomes
harder. For sellers, earnest money is a form of insurance, because most
people are unwilling to walk away from their payment."
这个对short sale的房子不适用吗？

发帖数: 420 | 7 房子是很好的，我也很喜欢，不过还没到非要不可的地步。我原来以为签了contract交
了earnest money对seller应该也是有一定的约束力的。现在看来只对我们buyer有约束
力，心里有疑惑，所以上来问问。

counter offer给我们。 是seller 在我们还没做出反应前cancel了我们的offer。

发帖数: 3244 | 10 it doesn't matter how the seller handle it, seller do have the right to kick
you out and in most states you as a buyer can do nothing about. ask your
agent and check your contract to see if you can find anything on the paper
saying the seller can not do this. if you can find some, you'll have a case.

other conditions, you can talk to the seller side.

发帖数: 5352 | 12 更大的可能是另一个OFFER已经是299K了，所以SELLER马上就接受了。SHORT SALE，你
出高OFFER没用的，SELLER又拿不到钱。他一般选最可能不会BACK OUT的人
