&S contract里面只有这么一段非常模糊的话:
"...said premises .. is to be delivered at the time of the deed, the said
premises to be (a) in the same condition as they now are, reasonable use and
wear thereof excepted... "
但是并没有一个单独列出的contingency clause,所以感觉上一段话非常模糊,没有指出
1。什么是same condition,
2。如果不是same condition,buyer有什么后继手段。看上去好像buyer没有
cancellation right,那么seller完全可以胡搅烂缠,而buyer因为已经交了deposit,
很难退出。
大家怎么看这个问题? |

the other party if they didn't comply with the signed document.It's your
agent's job to make sure you get the agreed list signed by the seller. Final
walkthrough is not that critical.

In order to fully make sure the repair is done or no more new damage, you
can rely on the inspector' memory or by taking it to your own hands by
taking many pictures and ask the sellers to sign the pictures. Neither is
very doable.
It is my understanding now that these are all gray areas. For example, if
the seller takes away an expensive light fixture, and replace it with a
cheap one. Or if the hardwood floor is damaged due to seller moving out,
the seller will claim the problem was present during the inspection.
Without pictures, you will have very hard time to argue against it.

transaction. So long the house is in the condition you saw before don't
worry about the details. The seller doesn't have magic power. There will be
always some dent or scratch here and there. What's a big deal? Life is full
of shit. We have more trouble to worry more than this. The only thing you
need to worry about is all the repairs agreed by the seller and make sure
you get all the receipts of the work.
