Hawker said only that the sale talks with Superior Aviation failed because
the parties couldn't agree on terms following the tentative pact in July
that would have seen the Chinese firm pay up to $1.79 billion, excluding its
defense assets.
"We made the decision to proceed with the standalone plan of reorganization
after determining that, despite our best efforts, the proposed transaction
with Superior could not be completed on terms acceptable to the company,"
said Robert "Steve" Miller, the restructuring expert hired in February as
chief executive.
Mr. Miller said in a statement that the company is disappointed the
transaction didn't come to fruition, but it had protected itself by
obtaining a $50 million deposit from Superior that is fully nonrefundable. | b*********c
