My 5 year old son Alex is the victim of International Kidnapping. He has
been taken to China by his mother, and she refuses to return him to the
United States. Any donations to this CrowdRise campaign will be used toward
legal and travel fees to safely BRING ALEX HOME.
Alex's mother and I divorced last year. We have joint legal and physical
custody. As part of our settlement I reluctantly agreed to allow her and
Alex to travel to China for 45 days on vacation. She told me a few weeks
after arriving in China that she had no intention to return him to the
United States. He was due to return on June 20, 2014. He has been out of the
United States since May 7, 2014 and has been living on an expired Chinese
visa since the end of July.
Once I realized that Alex’s mother was not bringing my son home, I
immediately began researching ways to bring him home myself. The more I
researched, the more I realized I could not do this alone. China is not
party to the Hague Convention which means that China has no obligation to
recognize foreign custody orders or assist in international child abductions
. I contacted the U.S. State Department - Office of Children's Issues, the
Local Police, the National Center for Missing and Exploited Children, and
the FBI. However, there is nothing that these agencies have been able to
really do.
I then contacted a mediation firm based out of the Netherlands that
specializes in international child abductions. We have spent the last
several months trying to get her to come back voluntarily so that Alex can
have both of us in his life. I even traveled to China in October 2014 with
several attorneys from the mediation firm to try and negotiate with his
mother for them to return to the United States. Unfortunately, I was
unsuccessful. That trip in October was the last time I was able to spend
time with my son.
I will never stop working to get him back. However, timing is everything
right now and money is a big part of getting the right people involved as
quickly as possible. That is why I am asking for the support of others to
help me in this difficult time. After a year long divorce, custody battle,
and now a nearly year long struggle to bring my son home, I have been left
in severe debt, wiped out all of my retirement savings, and I have nowhere
else to turn. I love my son very much and cannot imagine not being a part of
his life as he grows into a young man.
Our next steps involve the courts in China; which will be expensive and
require a lot of traveling back and forth. I've tried reasoning with her to
no avail. I have begged and pleaded with her to no avail. This is my last
legal option. She has completely disregarded the custody documents that we
signed together in good faith. She has selfishly told me that when we
divorced, I divorced Alex too. I fully planned to honor the conditions of
our custody agreement in spite of our differences. I feel so gullible for
believing that she would actually return with him. I actually took them to
the airport! I feel like such a fool. Please help if you can.

中国人默认是父母各方都对子女有处置权，就看谁出手快。中国相关法律对此是个空白。
而美国观念默认父母不过是孩子的监护人（而不是拥有者），即使是父母也不能随便处
置子女。任何一方对子女的处置，要求另一方同意。平时日常生活中当然大多数时候都
是父母双方同意的，没有什么问题。关键就是到了这种夫妻发生矛盾，离婚前后，这时
任何一方处置子女未得到另一方的同意，就是违犯美国法律，就是绑架罪。外F女这样
被FBI从待起飞的飞机上抓下来都好几起了。 |
