form 8812 may not be applicable to you. And I guess you cannot claim the
benefit any more.
I am in the same situation as you, so please let me know if you know a legit

Form 8901, Information on Qualifying Children
Who Are Not Dependents (For Child Tax Credit) –
Form 8901 is obsolete beginning with the
2009 tax year. To be a qualifying child for
the child tax credit for 2009 and later tax years,
a child must be a dependent, so Form 8901
is no longer needed. |
