吧?我也不是很清楚了。但是5000deduction是肯定可以的。 |

所以5000块好像还是有的。
但我当时是married,如果按dual status报不能file joint return and claim
exemption and deduction for my wife. 所以我又用了first-year choice, 按
resident报税,但按resident报没有tax treaty的5000块。 |

choice".
yes you can deduct $5k for your OPT income.

is still H1 in 2010, she can "back-claim" that for 2009 by using that 1st
year choice. there might be some limitation regarding days or others. check
IRS Pub.

you will be considered a US resident for tax purposes if you meet the
substantial presence test for calendar year 2009. To meet this test, you
must be physically present in the United States on at least:
1. 31 days during 2009, and
2. 183 days during the 3-year period that includes 2009,2008 and 2007,
counting:
a. all the days you were present in 2009, and
b. 1/3 of the days you were present in 2008, and
c. 1/6 of the days you were present in 2007.
