发帖数: 308 | 1 吃了张ticket，要去上庭。前几天去过court一次了（去schdule 上庭时间），感觉那
个老judge很油滑---他明确说 “如果别人告诉你，给你罚单的警察没有来法庭，你的
case就会被dismiss--this is not true!”
我感觉san jose的 traffic court不是很正规啊，担心我上庭的时候，假如给我罚单的
officer没有来，这个老油条法官会依然给判我输。
请教有什么办法避免这种情况发生？如果这种情况发生了，这个老judge 算违法么？

发帖数: 550 | 2 Okay, I have been to the Traffic Court in Santa Clara early this year for "
no turn on red" violation.
I first scheduled the court as you did. The judge is the law, you do
remember. On the day of court, it is kind of formal with ~60 people with
traffic ticket claims (as Judge Judy Show). The judge will ask you to cite
what happened that day and he will normally reduce the fine and with option
to go to traffic school to clear all the points. No police will show up that
day and you still need to pay the fine. You could risk to plea non guilty,
but they could result in being rejected and paying the original fine. |

一般上庭的时候，如果给罚单的警察没有来，case就直接dismiss了，但是现在有点担
心那个san jose traffic court的老油条法官不按照规则行事了。

倒你。 缺一条都不行。 另外就是警察的口述， 多问他问题， 在他的回答里面找矛盾
的地方。 |
