稍微补充一点:四五十年前AA的本意是禁止任何形式的种族歧视(1961年肯尼迪的
Executive Order 10925,"take affirmative action to ensure that applicants
are employed and that employees are treated during employment without regard
to their race, creed, color, or national origin."),根本没有要求照顾黑墨,
但在施行之中很快就变了调;现在谈AA,指的就是对黑墨的优待,完全不是当年的本义
。1996年加州Prop 209州宪修正案其实就等于把肯尼迪、约翰逊的联邦政令在加州层面
重复一遍,但人人都把Prop 209解读为禁止AA。
无论如何,劳模越生越多,占据人口优势是迟早的事,等到劳模联合老黑达到过半选票
,就有可能试图实行“多数人的暴政”,在加州废除Prop 209、在全美各地立法要求优
待黑墨。今年晚些时候美国高法如果能够裁决AA违宪,就可以在很长一段时间内避免这
种局面。
