发帖数: 1 | 1 儿子刚开学，学校组织了爬梯，遇到新同学，高兴之余，几个人跑出去刚喝了2口酒，
就被警察抓到(都未满21岁），要在下个月上庭，今天，儿子胆怯地打过电话来。没有
遇到过这类事情，除了教育孩子外，我们也不了解到底会有怎样的惩罚，在此，恳请明
白TN法律的朋友帮忙答复一下，特别感谢！！ |

发帖数: 2869 | 2 你儿子多大啊。。TN的警察不错啊，很厉害啊。我得小心了。你儿子如果18岁满了就让
他自己处理吧，对他自己有好处，让他自己为自己以后的行为承担责任，没啥的，小孩
子这种事情不会有大问题的。上庭结果一般最好可能会上COUNSELLING啥的或者社区劳
动 没有什么大罪的。放心好了。

哪见过类似的，就是因为不满21岁喝酒，好像罪名要根一辈子吧，你去咨询一下吧！ |

1) 交罚款、作义工
2) 缓刑，其间表现良好charge dismiss
My 20 year old son received an underage drinking citation in Tennessee. He
did not drink and asked for a breath test but was refused. He was in a
private home with several 20-22 year olds. All under 21 received citations.
Now he must go to court. On the citation the cops stated he admitted to
drinking, which he did not, and they threatened him with arrest if he
refused to sign it. Had he been arrested he would have been kicked out of
the private college he is attending so he signed it hoping to prove himself
in court. There were 2 or 3 cops there who I'm sure will back each other,
and only the kids to defend themselves. My son has never been arrested or in
trouble with the law/school. The police were driving by at 2 AM and a 21
year old was outside on a cell phone. I guess that person had been drinking
but was of age. The cops watched where he went adn followed him into the
house because they noticed others were in the home. What is our next step to
help our son?
Answer
You need to retain your son an attorney in the district where he is facing
charges. It sounds as if he has a potential suppression issue that could
invalidate the arrest (which would result in dismissal). Further, since he
has never been in trouble he will qualify for two types of diversion in
Tennessee.
1) Pretrial diversion is a memorandum of understanding between the state and
the defendant that is essentially an agreement not to prosecute the matter
in exchange for the defendant meeting certain conditions (probation, fines,
public service, etc)
2) Judicial diversion involves entering a plea of guilty under T.C.A. 40-35-
313 but the judgment of conviction is deferred for a probationary period
during which time the defendant must meet certain conditions
Both diversion programs result in the charges being dismissed and their
criminal records expunged. I should also mention that if he was charged with
underage possession of alcohol the statute has a built in expungement
feature (after the passage of 6 months).
As you can probably tell... this is a complicated matter and to put it
simply... he needs a lawyer.

多人情世故，律师会帮你求情probation..所以要有钱，要不自己就是律师
...
