Lawyers for Boston Bombing Suspect Want to Put Off Trial Until Sept. 2015
Attorneys representing accused Boston Marathon bomber Dzhokhar Tsarnaev are
requesting a trial date no earlier than September 2015 — nearly two and a
half years after the attack that left three dead and more than 260 wounded.
The request was discussed in a joint status report that lawyers for Mr.
Tsarnaev and prosecutors filed with the federal court in Massachusetts on
Monday. Lawyers for the 20-year-old suspect say they need the extra time to
review thousands of items of physical evidence.
“During a review of a portion of the physical evidence during the week of
January 13, 2014, the defense asked the government to copy various items
that the government had made available for inspection and review,” the
report states.
“The government agreed to provide copies of the requested items, but the
defense has not yet received the copies. The defense has not yet had an
opportunity to review numerous additional items of physical evidence,
including nearly 2,000 items that reportedly are still being analyzed by the
FBI and items kept at additional locations.”
Prosecutors are seeking the death penalty for Mr. Tsarnaev, who has pleaded
not guilty to all charges against him, including using a weapon of mass
destruction during the April 15 attack.
A spokeswoman for U.S.Attorney Carmen M. Ortiz said the government has
previously suggested a fall 2014 start date. The government anticipates a
trial lasting 12 weeks.
Gerard T. Leone Jr., a former first assistant U.S. attorney in Boston who
prosecuted terrorist “shoe bomber” Richard Reid, told the Boston Globe
that the delay makes sense given the complexity of the case. “Anyone who’s
been involved in such a case knows that it’s extremely labor intensive,”
