The plaintiffs in these lawsuits (white applicants who were denied admission
to these schools) are represented by an organization known as the Center
for Individual Rights, or CIR. For the past decade, CIR has been leading a
national campaign to eliminate affirmative action. Their first success came
in the Hopwood case, in which they brought suit against the affirmative
action admissions policy of the University of Texas Law School. The Fifth
Circuit Court of Appeals sent a shock wave through all of higher education
when it held, in the mid l990's, that Justice Powell's famous opinion in
Regents of the University of California v. Bakke, which created a majority
of the Supreme Court long understood as upholding affirmative action, was no
longer good law. |
