发帖数: 1289 | 50 美国的民事诉讼本身就是一个Adversarial system，诉讼的双方是处在对抗的状态，对
立的状态可以促使双方考虑很多“合作状态”下会被忽视的问题。也就是说，对立状态
下，双方会把对方存在问题的地方都挑一遍，很多潜在的问题都可能因此避免。很多人
只看到这种体制的浪费，但是无视了这个体制可能带来的好处。从某种程度上来说，八
哥的案子应该是医院最后一次因为翻译问题赔钱，7m的赔偿金足够给所有医院提个醒，
不要在这种小事上犯过错，也避免了很多类似问题
至于八哥的案子是不是frivolous litigation，民事诉讼又不是你想起诉就可以起诉的
，从起诉到正式立案到取证程序再到最后庭外和解，这中间被告有无数机会可以把你的
案子给解散掉，医院的律师团又不是吃干饭的
至于纳税人对这个体制不满由来已久，也确实有很多地方确实有需要改革，不过这些讨
论大都集中在学界纸上谈兵，比如民事诉讼程序向德国靠拢，比如建议把取证程序由双
方律师主导改为法官主导，比如取消陪审团制度，等等等等最后都是政治问题。因为这
种政治问题要求别人不去利用这个体制的好处，这不是脑残么 |
