结果是不出所料的,有趣的是法庭意见结构如此复杂,快赶上BBS吵架了。判决就分五
部分,然后ROBERTS和SCALIA各跟一
贴单有话要说,ALITO两贴都RE一下。THOMAS虽然RE判决但是不同意第四部分
disclosure requirement,STEVENS和其
他自由派都RE了THOMAS,却然后又写出90页的反方长贴狂拍判决其他部分。
粗粗翻了一下这个一共183页的大坑,觉得正方有个观点是相当有力,就是MCCAIN-
FEINGOLD有被滥用来禁止媒体发表倾
向性言论的危险,因为没有什么清晰的可操作的标准来区分“媒体和非媒体公司”。
STEVENS的反方砖贴里没有看到特别有说
服力的反驳。

主要是用Alito换了O'Connor这个温和派,才改变了court的组成。比如克林顿当年也提
名了两个大法官,但是这两个都是替换自有派的法官。所以不改变法院的组成。以前法
院有两个温和派O'Connor和肯尼迪。3个保守派,4个自由派。所以很多决定是看着两个
人的投票。这两位00年都是支持布什的。O'Connor和肯尼迪都是里根提名的。
另外有的时候总统提名的法官不一定是大家想想的。比如老布什提名的Souter。当时大
家以为他是保守派,结果他到了最高院后,直接就加入了自由派。让人大跌眼镜。当时
一个原因是Souter的判例很少,大家都不太清楚他的立场。
现在这种可能不多了,现在的提名人都有很多的判例,基本上大家都能知道他的立场了

几个基本点:
1)所有法官都认同AA不可以有racial quota,包括liberal法官们都同意。如果加
racial quota的话,想通过高院的概率非常低。所以Asian group诉Harvard那一案
Harvard如果不做改变基本没有胜算。可以发现哈佛近期Asian的比例终于突破神秘的20
%大关了。

我俩公认Cruz人品不好,做朋友我是绝对不会选他。但我也理解他,律师出身,都这德
性。
John Roberts不如alito,scalia,Thomas他们那样保守,但是在很多问题上还是很保
守的,譬如AA。当初提名的时候在,Cruz也就是以参议员身份表示支持而已。床铺就不
同了,他没有从政过,没有历史包袱。
你的第二点我没看明白,你如果是指要抵抗Obama提名大法官的话,那只有尽可能地挡
住才是保守派本色。否则不得了了,AA就全合法了。
把PP搞掉,才是极端保守派的做法啊。
我支持Cruz的可以作为保守派的几点是
1,税法简单,废除税务局
2,还土地于州政府,中央小型化
3,common core废除,也是小中央政府
好像还有其他几点,就不去查了,我反正初选选Cruz,大选选共和党。酱紫。

犯可以用合法收入來请律师。
这个案子是个和左右思想无关的小案子。两派大法官交错投票。3票反对的是保守派的

今天又眼巴巴地等我邻居案的判决,照样没出来。题目里的这个案子倒是判决出来了。
这个案子的情节是这样,某警察在下班期间在草坪上举着一个和现任市长竞选的人的牌
子,被人看见,第二天就被贬了。实际上呢,这个警察只是在帮他卧病在床的妈妈收牌
子而已,他也不在那个选区。
告到最高法院,六名大法官认为这警察的第一修正案权利被侵犯。虽然这名警察在举牌
子的时候根本不是在实践他的第一修正案权利,但是他老板要贬他的动机就是要侵犯他
的这个权利,警察老板坏了坏了的。
但是俺的俩偶像,托马斯和alito却不同意这个看法,俺一开始很诧异,仔细研究了一
下,明白了。他俩的理由是,连这个警察自己也不认为他是在实践第一修正案权利,那
么别人就无从侵犯他的这个权利。警察老板有这个想法,那不算。就像,我已经在脑子

Justice ALITO是保守我没问题。
但是这个案例里,高院整体对一个检察官的内心深处的推断过于武断,过于想当然。完
全没有公正好言。体现不出高院应有的思想水平。

2016年6月23日,這一天對所有的亞裔,尤其是華人來說,是令人遺憾的一天。當天上
午,聯邦最高法院以四比三做出裁決,認為德州大學(Fisher vs. Univ. of Texas)
在招生中將學生族裔作為錄取條件之一合法,並不違反憲法(lawful under the Equal
Protection Clause),這是聯邦最高法庭第二次就大學招生考慮族裔而做出判決。此
判決將為很多大學搞族裔配額提供法律支持,而華人控告哈佛等名校招生歧視訴訟將陷
入困境。
在2016年的今天,大學還可以根據族裔和膚色來決定是否錄取,這是有關美國族裔平等
最大的笑話,也是對亞裔最大的羞辱。喬治奧威爾的政治諷刺寓言「動物莊園」,動物
領導說,「all animals are equal, but some animals are more equal than others
.(所有動物一律平等,不過有一些動物就是比其他動物更平等)」,這句話在美國演
出了現實版。
在大學錄取考慮種族的政策下,亞裔的孩子必須要比其他族裔SAT成績多考150分才有機

属实,楼上两位都是内行。
基于种族的特殊政策。一定要通过最高的严格检视标准。这是由高院判例决定了的。
基于性别的,检视标准没有那么高。
当然,在执法玩法的左派大法官和冒牌保守派大法官面前,严格检视就是一张卫生纸。
