最起码，我自认比维基写的还公正。
你的这段描述和前面那位朋友一样，完全属于自己想象。有点类似于自由派大法官胡乱
解释宪法。对保守派大法官的目的脑补太多。大法官和政客不同之处，不管动机如何，
大法官的观点都必须写在纸上，只有这些写在纸上的才算数，大法官在写这些观点的时
候，都要考虑就事论事，立场超然，逻辑完整。
当然，自由派大法官已经把自己当成政治家，甚至社会活动家了。Sotomayor在演讲时

其实保守派大法官在Fisher案子上的判断，
更接近于反对教育界搞出来的激进的社会变革--AA
认为这种社会变革缺乏社会和法律基础
比如如果你去读Alito的反对意见，
就会发现他反对的AA是98年Top10percent Rule生效之后
UTexas继续搞AA这样“激进”的社会改革
而这种变革其实不过十来年时间，
所以他其实是要恢复04年以前的体系，也就是96年的Hopwood decision
认为这个新AA在Top10percent Rule生效之后已经没有了任何基础
应该保守的退回去。。。
而不是“激进”的改变42州规则，向前走。。。

据说Fisher一案第一次上高院，本来要判Fisher赢，骚他妈呀写下了一封悲壮的撕逼判
决观点，大法官们一看，不得了，闹大了，发回重审算了。
第二次上法庭，肯尼迪却改了观点。所以alito 在占全长三分之二的反对观点里，第一
句话就是
something strange has happened....

常小，而且现在不断爆出这个夏天有人会退休的消息，这个人八成是Kennedy，只要
Kennedy一退休，最高法院就会形成5:4的稳定保守派格局，到时候保守派里面最老的两
个，Alito和Clarence，也不过70左右，所以根本没有必要和猪党谈deal。至于
Ginsberg和Breyer，肯定是能撑一天算一天了 |

如果Kennedy退休，老川任命的应该是类似Gorsuch一样保守的，到时候Roberts就是保
守派里最不保守的了，倒并不一定说Roberts会变成Kennedy这样的这样swing vote
P.S. 我同意你的看法，Roberts当时投Obamacare赞成票的主要说法是不想legislating
from the bench，而是把立法权还给两院，从这个角度来说，确实是忠于宪法的保守

organization就可以来，最高法院判不行除非9院说行。traveler还可以用extended
list， 给不给visa就看签证官的了。目前block了大约24000 refugees. 3个高院法官
说支持full travel ban. 10月份会就travel ban正式开庭。
不明白为什么高院还要加一句，除非9院说可以。如果9院同意了夏威夷法官的，
