签证办公室（Visa Office）通过对cut-off dates的控制，在财政年度（每年十月为财年第一个月）的前三个季度对职业移民类缓慢释放签证名额（比如在2011财年，职业移民类前三季度仅仅发出了年度总额58.6%的签证数），在最后一个季度才大幅度移动cut-off days放出大量没用完的名额。导致绿卡申请人的等待时间被延长。并且由于移民局资源有限，如果在最后一个季度没有及时处理足够的申请，绿卡签证名额就会被浪费（移民法规定，一个财年没有用完的名额不能挪到下一年使用）。近年职业移民绿卡申请严重积压，如果绿卡名额再被浪费，积压的情况就会被加剧。
按季度分配27%的职业移民绿卡名额的好处：
1. 能缩短绿卡申请人的等待时间（比如很多申请人就能在２０１１年拿到绿卡而不必等到２０１２年夏天）；
2. 尽量避免绿卡签证名额的浪费
法律依据：
ＮＩＵ聘请了专业律师对移民法进行分析研究，认为签证办公室目前的季度分配现状不符合移民法第201条27%限额规定的立法精神，我们需要做的就是敦促移民局提高效率依法办事。

纹的采样位置，我的case是在三番的office被处理的，那个office现在正在处理三月二

计能达到eb1ab及其家属的2倍，而eb1c的abuse正是eb1 backlog的主要原因之一,同时

generic叫了很多年，FDA都不愿意。以前ANDA average approval time是12-18个月，
今年年初的GPhA年会上，FDA新的头头自己承认现在已经到了27个月，而且继续在拖，
因为积累了成千上万个。2003年的MAA （Medicare Modernization Act）加了些
forfeit 180 days exclusivity条件，其中最要害的一个就是fail to obtain
tentative approval in 30 months after submission。FDA如果30个月内因为FDA
backlog问题审不完,First-to-File本来可以批,现在批不了,要面临失去exclusivity,
可以想象,FDA要面临多少官司. FDA现在是拼命维持,据OGD没公开的消息,FDA现在都不

但有一些申请仍留在San Francisco及 New York regional office继续审核，而这两个

入后才会对此申请发出45-day letter，但现时90%的申请都只是被输入部份的资料，这些

首先声明一点，我不认为HR 1044法案会通过，参议院的反对力量太强，HR 1044通过的
几率很小，此贴只是闲得无聊纯讨论玩玩。
（1） HR 1044的通过是不是对中国移民的毁灭性打击？目前印度EB1的backlog相比
EB23少很多，之前中印捆绑就说明中印的EB1 backlog相差不大，如果HR 1044通过，中
印一起吃ROW的配额，中印EB1的排期问题会得到很大缓解，所以通过HR 1044对中国EB1
算是利好。但对于中国EB23算是很大的利空，网上估计排期可能从目前的三四年要增长到
十年。EB5重大利好，可以立刻独占所有的配额。对中国家庭移民利好，国家配额从7%增
长到15%。中国每年EB1, EB5和家庭移民数量的增长可能多于EB23移民数量的减少。这不
是毁灭性打击，只是蛋糕分配变了。

还有57000在backlog，不懂加州咋回事，如果使用商业lab, 2天左右的backlog就没了
，难道加州的州法不允许商业lab?
: 华盛顿州阳性率7.1%，算是不错的了
: 加州其实吓人，阳性率18.2%，其实只测了20000个，还有57000个结果pending的
