Intent的签证包括有H1b, H1c, L1, O1。
H1期间，如果申请了485，出境之后，还可以用H1回来。当然，你也可以用AP，你的H1
arguably 仍然有效。O1，如果已经递交了485，就一定要用AP重新入境。

己开公司）一封，美国教授一封，两位编辑各一封。文章数目没有增加，引用从151增
加到了171次，审稿从31增加到了36次。虽然引用数目还行，但是，没有一个引用是大
家所认为的亮点。所有的推荐人没有一个业内的牛人。所审的稿，除了plos one用
google的排名，看起来还行，其它都是不知名期刊。律师建议在感恩节前送出RFE
response，好让移民官一边吃这火鸡肉，一边审我的案子。结果证明律师是正确的。我
只能说，自己比较幸运，碰到了比较好的移民官。

本来对于使用AP没有任何疑问，可是刚才律师说这个是个灰色地段，用了AP会影响H1B
status。因为如果是用AP入境，入境的时候海关会给一张新的I-94，上面写的是AOS（
有效期是一年），I-94是我们在美国合法身份的文件。换句话说一旦用AP入境，我们就

This career progression item for manager promotion is quite useful (at least
for me). I was recommended for promotion to manager (from developer) twice
and shot down by immigration lawyer twice.

找了律师，先提交eb1a然后追加pp，一周后收到NOID。IO判断单项满足标准，但
totality不够，NOID notice很长，批判的点比较多，我看不出IO真正关注的是哪一点
或者是每条都不放过，我总结了要点如下，也把原文附在文后了。
Review：
1. 仅有审稿的客观证据不足以证明sustained national or international
acclaim
2. 审稿次数被律师搞错了！

加了四封推荐信（都是引用过文章的人），要了几封editor的信证明是领域top的人才
能被邀请审稿，
最主要的还是要挖料挖料挖料（之前不上心 惨痛教训啊筒子们），然后要在推荐信中
体现， 另外最后决定的回信策略是相当于重写了一遍PL， 而没有针对io逐条反驳（因
为可能就是个模版io拿来贴一下吧）
感觉这个0201还算比较公正，也有可能holiday season了，心情比较好^_^
以上希望可以给大家一些回复noid的参考信息，由于一些原因，更详细内容就不方便写
了，有问题欢迎私信询问！

发帖数: 1627 | 21 本人学业不精，permenantly head damaged，真是汗颜，现在知错就改。以前总觉得
EB23闹成这样有失体面，在于我只注意了AP的便利性（H1B也可以往返，并非生死问题
）和EAD可以让配偶工作，而忽视了EAD的另一个重要性。经过某些EB2的再教育，体会
到了为什么EB3应该全力阻止EB2降级。
其实最重要的是EAD的一项功能。根据AC21法律，在485上交180后，不仅仅可以换工
作（前雇主撤掉140也没关系），还可以在失业的情况下保住身份，重新上路。那么485
就不是所谓锦上添花的效能，而是可以和绿卡比肩了。
基于此判断，我鼓励所有的EB3使用各种方法保住自己的排期，坚决阻击EB2的降级。

scope：“猜心思” predictor 太难了，实际点，binary classification：to 追, or
not to 追。就直接出货了。
当然 binary classification 常常不是很 smooth，于是会发生前面说的 “一分钟前

发帖数: 450 | 33 去年公司律师把我的H1b耽误了，只好办O-1。 看版上O-1的资料很少，来写个简单的过
程让后来者有点参考。我是social science 的，1作3篇，2作1篇。都是行业内很好的
journals。 引用不到10个。我们专业引用很少，所以10个应该还行。review 16篇，7
个journals的，但是律师给我报错了，只报了一半。博士和博士后都是藤校。
我是从12月开始犹犹豫豫地准备，1月份终于老老实实要推荐信。2月份pp交上去被退回
，律师忘了交申请费！重新交了以后两三天就批了。我是从J1到O1，说需要尽快上班。
我拖了3个星期才上班，律师说没关系。
整个过程基本上跟版上准备eb1差不多，要的材料也差不多。只是我的律师要10封推荐
信。我给13个人发了email，都答应了，我只好准备了13封信。11封都是美国的，欧洲
一封，中国一封。有工业界也有学术界的。现在的老板也写了一封。我的大部分推荐信
是根据本身找工作时候的推荐信改的，就是外加了很多形容词。
O-1要求8条中间满足3条。我的律师从来没有告诉我他要claim哪几条，最后的petition

享下。RFE的response其实也就是再重新组织材料，重新写的petition letter.
看到RFE， 我感觉IO根本没怎么看我的petition letter, 所以在准备response的时候
，都时时考虑，如果IO粗略扫一眼的话，他能不能get the point. 所以用了很多下划
线，加粗之类的highlight 关键词。格式上每一项，每一小项都分清楚。那些个比较复
杂的证据，如果不是非常强，宁可不要。

mention whether EB2 PERM can file EB3 I-140:
USCIS will continue to accept amended or duplicate Form I-140 petitions
that are filed with a copy of a labor certification that is expired at the
time the amended or duplicate Form I-140 petition is filed, if the original
approved labor certification was filed in support of a previously filed

四点可以重发I140的特例
1）公司换了
2）前面一个I-140没被批准
3）修改老I140的分类
4）老I140遗失了
你从哪里看到了可以在老的有效的I-140已经存在的情况下，重新发一个不同类别的I-
140？你连字面上的意思都看不懂，亏你还引经据典，还特别把“3）修改老I140的分类
”拿出来。
实话告诉你，如果不是看到2000年和2001年也有人讨论过类似的事情，我一定会坚持你
被律师骗死的观点。很大可能，你的EB2会因为“3）修改老I140的分类”而废掉，变成
转排EB3的队。
我钦佩你的勇气，敢吃螃蟹，但是假如你吃的不是螃蟹而是河豚呢？
