你想拿钱，第一次就只能拿到他保险公司估的，但是你要是修车，他保险公司会和
bodyshop联系，出全部费用
所以这就是为啥你要是直接拿钱，只能拿2000多，去bodyshop估价却是3000多,其实保
险公司也会和bodyshop讨价还价，打个折扣啥的，这也是为啥保险公司估价会比外面
bodyshop略低
你要打官司，干脆就去最好的bodyshop估价，然后拿这个估价和他保险公司联系，只要
能证明这个估价是合理的，保险公司会多赔钱，如果它不愿意，上法庭告也行
不过这种没有油水的小case，没有律师会愿意接的，只能你自己发挥了，对方保险公司
也不会为这种小case和你上庭，它多付的律师费要比多付你车的赔偿贵，所以只要估价
合理，这钱你肯定能拿到
至于diminished value，各个州各个保险公司规定不一样，你要想要钱得自己研究，上
法庭只要有理由，对方保险公司肯定会赔 |

事情简单经过：
１）事故，对方全责，无伤亡；对方保险负责修车。
２）经人提醒，作了Diminished Value Appraisal, 并发信给对方保险公司要求赔偿，
久无回应。
３）无奈，到小额法庭诉对方司机及车主；法官判对方赔付，但数额太低。（本人缺乏
经验，没有叫
Appraiser 出庭作证，而对方有，并压低数额。）
４）本人不服，提出上诉，并准备请 Appraiser 作证；现等确定开庭日期。
现有以下问题，希望有经验或法律知识的网友们指点：
北卡州似乎规定经小额法庭判决后的上诉案作为新案处理 (Trial de novo) 而且是在
地区法院

车已经在我指定的一家修车铺里了。保险公司damage评估1,400刀，修车铺估的是2500
刀，说是保险公司派的那个评估的人根本就没怎么看，好几个很明显的地方都漏掉了。
总之，他们之间要协商去了。
至于diminished value,保险公司说给我1200刀，还告诉我:"我们就只能给你这么多，
没什么商量的余地。"很拽的口气。我觉得这个也太低了，于是找了一个专门作
diminished value的地方咨询，他们说1200刀确实太低，但是只有等我正式雇了他们之
后，他们才能做全面准确地评估，所以现在他们也不好说究竟diminished value是多少
。因为要雇这个地方出具专业的diminish value评估报告要我自己掏400刀。就怕到时
候和保险公司折腾得时候，最终没什么结果，我还白白花了这400刀。

再看那个州追溯交通事故的statue of limit是多久？ 一般很多年
再作一个reasonable的diminished value evaluation:
我之前一辆2年半新的Camry 索赔了$2500. Insurance company 会想要给你个低价尽快
settle. 我一共打了6次电话，做了一次market analysis。保险公司给的赔偿金从300
一次一次涨到了2500。接近于我做的diminished value evaluation. (大概$2700)
我之前做的是拿我现在的车去Carmax 做一个appraisal 得到一个价值 A (Carmax
aprraisal 是有证书的，而且是免费的）
找一下KBB 对你的车（如果没有撞过）情况下的最低的trade in value 的估值 B
找一下网上二手车市场相同车型，年数和里程数的的车， 多找几辆平均一下售价 C
没有事故的车 售价C 减去 最低估值B 根据不同车型大概会2-4千的差价 （dealer 合

LP两年前车祸，对方闯红灯，对方负全责。这一点对方保险公司STATEFARM没有任何异
意，给我们修车后同意付Diminished Value。但是把这事让一个律师来处理。这个律师
找了一个为保险公司服务的评估公司，估了一个很低的价。我们感到这个估价很不合理
，咨询律师之后，我们找了一家独立评估公司估价，发现STATEFARM的估价只有正常评
估公司的1/3左右。
但是这个评估发给STATEFARM之后，STATEFARM的律师对我们所有的问题都不回应，只是
要求按照他找的评估公司的估价赔偿我们的损失。
我们为此咨询律师之后，律师要我们到小额法庭索赔，按照律师的估计，这件事明显不
合理，STATEFARM不会为此打官司，问题很容易解决。另外，律师建议，由于数额不大
，可以自己代表自己，可以先不邀请我们找的评估公司的人出庭，以节省费用。
在开庭之前STATEFARM没有和我们联系和解，于是前天走向法庭判决。在开庭之后我们
发现问题。肇事方是一个律师，法官都宣称认识被告人并熟悉被告人。STATEFARM的律
师当然也认识这些法官。

发帖数: 350 | 40 不好意思，前段时间太忙，没来得及做更新。最后的结果是：上小额法庭，法官判决
Geico赔我2000刀的diminished value。基本达到了我的目的。
事件处理的过程分享给大家做个参考。
1) Geico从始至终不承认事故车有diminished value这个事实。不愿意make any
settlement。背后的原因（我猜）是他们在我所在的城市有全职律师专门负责打官司，
上庭对他们没有额外的cost。
2）据此，我选择了和律师合作。和律师谈的deal是：赢了，他拿走1/3；输了，他不收
任何费用。
3）我没有通过律师找appraisal，因为他提到他找的appraisal出庭要按时间收取一定
的费用，financial risk太高。所以我是在网上找的的http://www.avrecovery.com。他家收费是appraisal报告220刀，后面电话出庭免费。事后证明该appraisal的上庭经验和专业知识都很丰富。没有给Geico留下任何可challenge的地方。

Indeed, there are many Ph.D. programs that can be closed. The first one on

症（Bipolar disorder）均为独立的疾病实体，相互之间没有概念从属关系。张纯如的
诊断最初是抑郁症（Major Depressive Disorder），后来有医生诊断燥郁症（Bipolar
disorder）。这两个疾病都没有妄想表现。
1. 抑郁症是独立的疾病实体。 Clinical depression goes by many names --
depression, "the blues," biological depression, major depression.
