我从去年六月懵懵懂懂地来到这个版上，问了JWE无数问题，现在他叫我做点关于HR3012的事情，我当然一口答应，何况这个项目将会帮助PD是2009下半年到2010年年初的EB2早日拿卡，帮助2010年下半年到2012的EB2早日递交I-485呢！
至于EB3,现在应该看到85%的数字太高，参院已经有人出手。有人估计最后能以75%过关，有人估计最后能以60%过关，有人估计更低。如果EB3有能人，可以算一个对EB3C利益最大化的数字，我们一起放在项目里。如果没有人算，我们就用老猪下面跟帖里面说的50%。这个数字将能够有效卡住EB3I，帮助EB3C排期大进。

要想好自己索赔v.请律师得到的哪个多。这里不是中国，精神损失不是你说损失就损失
的，你有精神科医生的证明吗？凭什么说你精神有损失？这个损失，必须用物质来衡量
，怎么衡量？对方如果没有故意，exemplary damage无从谈起，而NIED的赔付一向非常
严格。respondeat superior听过没有？这些都是要钱的法律依据。
大多数ERISA plan有subrogation clause，就是说你从3rd party拿到的赔偿，你的健
康保险公司有优先权，先于你拿到钱。11th circuit and 9th circuit你可以多拿一点
，否则你打官司，要钱，都是是为了你的健康保险公司打工。上面说的这些如果从网上
google就弄懂很容易要到钱，那么律师就没有存在的必要了。 |

至于exemplary，你上庭扮扮可怜，让人觉得你一个弱女子没法粗鲁、欺诈、调戏，胜
面还是挺大。先咨询下学校律师。我以前学校有人遇到类似情况（据说是违章停车跟拖
车公司argue时情绪激动了），甚至搬出他们系主任上庭作证他一直是好学生。 |

身边的好多old boys' club的人物都不是会讨女人欢喜之人，但是他们之间能有共同语
言，能相互接纳和容忍，把事情决策好，这种协调合作的能力，也属于情商的一种吧。
