拿给学校签字。 结果学校那人坚持不要律师file pp，而要由学校file。 又打了一份
有学校信息的I907。
不知道这样会不会有问题，由律师file 的140 然后由学校file pp。到时候万一有RFE
是谁管？？

H1b都是今年9月中就到3年，需要renewal。
我的背景一般：
US PHD 2008,Biomedical science.
9 journal paper
8 published conference abstracts
79 citation
现在在小公司上班，公司背景也是刚刚足够support Eb1b。申请费用要自己出。
几种option，不知道选哪种好，请教各位的意见。
1. 140，pp，485 non-concurrent.
Pro：如果140 5月中就批了，马上递485/EAD。EAD一般90天就批？8月-9月初批EAD的话
就不需要办H1B。如果140 到5月中还没批，等到7月份再办H1B renewal。
Con：背景不强，怕被RFE。
2.140， non-pp，485 non-concurrent. 我和ld现在file H1B renewal。

很重要吗?
2) 貌似E-FILE的时候,最后所有材料都要求寄到NATIONAL BENEFIT CENTER?我的485貌

approve了，然后就能拿到EAD。
如果OPT期间可以file NIW的话，我的专业OPT可以有29个月，现在处于第2个月，是不
是等刚完成OPT extension的时候file NIW比较好，因为不然现在file NIW，万一拒了
，连extension都没有戏。
如果OPT期间不可以file NIW的话，那是不是尽快转H1B比较好。现在我的情况是如果想
办non-profit的H1B的话，还是有可能的。因为现在找的工作是两年的，等OPT用完24个
月的时候，还要重新找工作。这种情况的话，就不知道是现在转non profit H1B好，还

现在140是叫律师在办理，律师也叫我连同485也一起办理了，他的理由有两点
1. 可以提高140的通过率
2. 可以缩短时间
可以缩短时间我觉得是的，毕竟不用等待140批复的时间。但为什么485跟140一起file
会提高通过率呢？
我想自己做485就好了，律师费还挺贵的，办了个绿卡都花了要近一万刀了。我跟律师
说我做好485后发给他，让他和140一起file。律师不肯的，不肯的话也能理解的，但律
师给我的理由如下：
要我485和140一起file不是简单的把485放在一起递交上去，他们必须用他们的申请策
略才能使得申请更容易批准，简单的放在一起递交上去没啥用的。我就有点糊涂，递交
485的时候不是就那一些表格还有physical exam吗？这期间还能有什么策略说能提高通
过率呢？另外就是要递交485的时候不是需要一个140递交后的一个号码吗?如果没这个
号码，律师怎么来交485呢？是不是律师也要等到递交140后得到这个号之后才能递交
485呢？

上周四他把资料寄到公司的HR签字，
HR的人昨天告诉我上周五就给律师发快递寄回去了（这点要很赞hr的效率！）
律师昨天周一早上应该是收到快件的，
结果今天周二早上一大早来信说：will try my best to file this week, however,
you know, our office will be closed most of Wednesday, and Thursday, Friday.
Will definitely file your case early next week.
我心里虽然是火大，但是想想还是别rush律师这周file了，万一出个错就又我喝一壶的，
而且我也宽慰我自己，反正这周uscis也放假，即便file上去寄到了也没用，
干脆还是等下周再file吧！
应该把所有律师都枪毙了。。。。

之后再弄，J1 visa作为垫底。鉴于我这种律师建议我选择immigration Visa，意思是
说可以在中国file 485，如果后面满足条件后也可以再美国file. 不知道有没有朋友是
我这种情况，希望给点建议。我是怕我选了这个就不能在美国file了。我既不是党员，
也没有国家资助，J1 waiver不应该是个问题，J1身份也可以保持到那时候。如果不影
响到话，就听律师的。

and thus I can change job without having to file a new PERM. If I file a
new PERM, it will be treated as the "sole purpose of immigration benefit".
Department of Labor prohibits one employer does this twice for one employee.

原来140 的PD 是EB3的,08年的，目前EB2 和EB3 都是current，这次perm file的时候
要求5年以上工作经验+硕士以上，原来是冲着EB2去的。现在file 140的话，是不是
file EB2 更好？另外，是不是要求485同时file比较好啊？ 140 可以pp吧？
LD刚转成H4，等着EAD 卡工作呢。求大侠建议，怎么跟律师说比较好。

顺风车，可是情况有点尴尬，恳求大侠们指点！
我的基本情况：2012年交的EB2 PERM，priority date是2012年11月14号(尴尬。。。).
之后有点倒霉，PERM被audit了差不多一年，最近才被批下来。所以我没有EB2 140. 现
在要开始申请140。
看很多人说起用同一个perm，可以同时file两个140。我很想试一下。现在虽然EB3已经
很接近我尴尬的PD，但是也不知道接下来能不能继续推进，推进之后会不会马上大幅倒
退。同时申请两个，可以最大化机会，同时保证自己比较安全。
问题：
1：像我这种情况，140要开始，同时file两个新的140，可行吗？有成功先例没？USCIS
要是看到我同时file两个新的140，会不会惩罚我，把我两个140都据掉？有点担心阿。
。。
2：如果公司律师不同意我同时file两个140（还在艰难的周旋中...），对于我这个尴
尬的情况，如何操作比较安全？是等eb3变current， 同时file EB3 140/AOS， 还是有
更好的办法？ |

1. Clear data： 比如提交copy，一定要清晰。因为这些supporting doc可能会再
被copy or scan，而adjudicator看的可能不是你提交的copy。所以提交件一定要尽量
清晰。
还有如果form有选项选错了，更改了或者涂抹了，有可能mailroom copy，scan的时候
，你原来的选项还是能可见，就会造成不必要的误会。
2. Consistent data：比如name， A#， DoB， 所有的dates， 一定要前后match；
Form 和supporting doc的data要match；G-28上面的applicant info和form里面的要
consistent。
3. Correct data：比如正确的pay check。 如果提交几个forms，最好分开用
separate checks.这样哪怕一张写错了，不影响剩下的application。否则如果一张大

我在旧公司拿到i140之后跳槽在新公司重新办了perm, 刚刚得知perm 批准了，准备
relink to original pd. 由于旧的pd刚刚好current, 律师准备concurrent filing
140 and 485. 当然希望这个月新的排期出来不会倒退。。。
请问我这种情况需要pp 140吗？ 如果公司不愿意pp 140, 我可以个人掏钱要求pp 140
么？ 现在当然是想尽快file 485, 请问最快多快可以完成filing? file 后如果我的排
期短期内不后退大概多久可以拿到ead? 多久可以拿到绿卡？

发帖数: 62 | 50 还没file niw的140，律师收集140信息的时候说建议选择apply for an immigrant
visa abroad to be admitted as a US permanent resident，而不是file 485。理由
是选择回国申请移民签证依然可以在美国file 485。但如果选了file 485,而最后因为
种种原因需要回国申请移民签证，那么还要file额外材料以及收费。是这么一回事吗？ |
