那我现在算out of status吗,还能继续在公司工作吗,对我绿卡申请会有影响吗? 我同
时也file了
140在去年的summer,140在今年的3月批了,可是今年3月我的h1b已经过期了,难道批140
的时候不用
看h1b吗?

经过一番律师咨询和两天的纠结，我和未婚夫最终还是决定从了先转F2，然后再慢慢找

本人L1a，公司从去年底开始帮忙走EB1c绿卡流程。据公司律师说4月初已经file了140
，但到现在没有任何消息。
是不是至少应该有一个notice寄到家里说已经收到材料了？
另外我有同事早我一点file，用的是concurrent filing，这样很快就能开始申请AP然
后出差就很方便了。
但是轮到我不知道为啥就没有用concurrent filing，心中有些忐忑，觉得是不是公司
觉得不够有信心？
然后律师告诉我说现在140处理得8-10个月，这样下去我的visa都过期了还弄不完，完
全没法出差了。
实在是不想重新签L1a，而且也不想老因为等着这个卡浪费青春。
这两年在这边已经错过了不少国内外的机会，眼看着就老了，为了这个绿卡还不知道要
等多久，搞得完全没法做长期的人生规划。
希望有经验的盆友指点一二，如果是2015年四月递交i140，大概多久能够拿到卡？ |

对方提出的建议是：
一、为了说服国会相信ICC们的确是在滥用Multiple filings，
需要充实的证据，尤其是有关虚假雇佣的；
二、虽然抽签已经结束，但在USCIS发出approval notice之前，
我们还是可以有所作为的。
现在希望大家能够把收到的来自ICC的信以及自己收集的证据发到

并附上这些ICC的网址。
由于事关紧急，希望大家在明天东部时间午夜十二时之前完成，

我的140和131都是e-filed，去年EAD也是e-filed。我今年的131是3月1日efiled，移民
局的收据就是当天寄的。
我当时是07年7月24日efiled，26日收到收据的。我7月31日晚上寄的补充材料。我觉得
你再晚一两周应该没问题。晚过一个月，估计移民局会给你发信问你要initial
evidence，其实也无所谓，就把材料交上去就好了。
着急就先e-file吧。这样即使移民局耽搁，你也能很快收到收据。

还有就是在填filing status的时候，有这么个问题：

organization, or Canadian Custom Harvester?*”
下边有一个选项框，列了4个service center.是不是在这里选择究竟把材料寄到哪个
center？如果
在这里选了某个center，是不是上边那个问题就得填Yes?

０８年file的eb1b, 到０９年底不幸reject 了。因为０８年同时也file 了 ap 和
工卡申请。所以１４０被拒绝的时候，有这些冬冬，但是没用。
０８年file的niw, perm １４０ 都批了。拍期是０８年底。
今年５月底，用自己最后一点力气把eb1a 也file 乐，不过没有pp, 而且efile 的第六
天才把supporting document 准备好。寄出去的时候为了省油费，寄的是fedex tsc的
地址，不是pobox那个。所以，到现在查状态，还是什么都没有。停在initial review
。 不知道材料寄到了没有。
今天收到了485 打指纹的预约。诡异的是case number竟然是已经被拒掉的eb1b case
number. 所以，我也不知道是我自己晕了，还是我申请得太多，uscis晕了。
这种情况我应该aos 打指纹吗？ 现在我是h1b.
要不要通知公司律师呢？公司律师帮我准备的eb1b case. 不知道我表达清楚问题了没

officer's IQ to be too high.
we put two filings in the same FedEX envelops, however in separate internal
white envelops, and makde it very obivious that there are two filings, with
a big font conver on each internal envelop.
and their mail room process in batches, so it could be just the other
receipt will be in the next batch. it happened to us for the N-400 filings. |

lockbox，由于这个lockbox比较新，这样根据他们的经验会delay。另外从版上考古，
发现interfile的485通常要4个月左右approve。而concurrent file的approve的要快多

checking the generated pdf after aubmission, I noticed an error: in Part 6.
4. "Has any immigrant visa petition ever been filed by or on behalf of this
person?", BOTH No and Yes are checked. During e-filing, I did have some
trouble when providing the info of my previous NIW 140 (the e-file system
won't let me go though to the next step). I think I clicked No at some point

一个月左右。
但是原因是多重的：
1。concurrently filing交上去以后，FP/EAD/Ap就是开始处理，不管140怎样。这样省
了至少15天时间。
2。 concurrently filing直接交到service center,不是lockbox,又省了一到两个星期
材料转交的过程。
但concurrently filing不会让你插队， 这是肯定的。 |

不能用H1B了。但是10天前我concurrent file了140和485 （以及她的485）。现在我们
的case都是pending of AOS。 据说这种情况，她是合法留美等待，485的收条就能
cover她。我还需要给她file H4么。file H4的好处就是将来我的140不批，她还有合法
身份。不知道有没有同仁confirm一下这种情况。另外，file H4会不会影响她的 485
和 EAD 申请。这好像比较矛盾，EAD 允许她工作， H4不可以工作。移民局收到这两个
申请会不会晕掉。多谢前辈指点。 |

I485。但我老婆还在念PhD第一年。到了马上要提交的时候，才在网上发现要是我的140
被拒的话，我老婆可能这几年内都不能回国。所以在想到底是pp还是cocurrent file我
一个人的i485，她的等140批了再file。PP的话，可能这部分钱要自己出。我倒没想着
要马上换工作，只希望早点批了省得记挂着这件事。另外，如果现在cocurrent file我
一个人的case,不知道我老婆申请485的时候到时候会不会有什么风险。请各位给些建议

第一部分：I-140 E-File后的故事。
４月２８日电子提交，４月３０日邮寄支持材料和PP表格，５月２日签收，５月９日批准。
周一（4月30日）邮寄完材料后，大舒一口气。本来在想该干嘛干嘛，其实也正在这么干着，哪知道中午突然收到PNAS的审稿邀请，难过得要死，真的，本来想忘记这么回事，突然来这么一出，让我有非常不好的预感，感觉自己要RFE了。后来实在坐不住，就出实验室去图书馆查询邮递信息，上MITBBS根版，扫号。刚开始笨，手动扫，扫了大概两天，大致知道了我周围号码的情况，恐怖啊。平均每1000个号里竟然有200-300个 I-140，心想TSC 这哪里忙得过来，后来直接集中搜集直接PP的号码，在9001-9999里面搜集了大概25个直接PP的case， 时间跨度在4月18日到30日之间（按电子提交日期算），一并订阅之。当时这25个里面已经有批的，比如26，27日就批，加上之前有别的网友如ALLKNO... 阅读全帖 |

$1700.
By checking the website, i found that
for form 131, filing fee is 360,
for form 765, filing fee is 380,
for form 485, filing fee is 985.
With adding three together, they are not 1700. Also i found all three forms
can be filed together with a fee of $1070 from USCIS website. So is is 1070
or 1700?

然发email说准备这周五file 140
很早时候和律师见过一面，大致讲了一下我的research，问了几个问题。后来就是陆续
drop off 各种她要求收集的材料。认识一个人也是这个律师办的，说律师是不给申请
人看最后file的package的。我有些担心律师如果万一不是特别清楚我的research，抓
不住重点，还不让申请人file之前看一下，是不是有risk。准备明天发email问问律师
是否能file之前见面讨论一下，不过还是想先发个帖子上来问问是不是大家都是这样的?
感觉自己case不是很强，不知道该不该pp。问律师，她说I am not a big fan, but it
's up to you.
简单说一下我的情况吧：
美国普通学校PhD，postdoc position不过有做title change
13篇文章，英文1作4篇，中文1作1篇，其它6英2中
会议文章只有1个, 一堆poster presentation

file提前知道case number，而且直接告诉你把材料往哪里寄，就不存在TSC NSC收信地
址和lock box之间的疑惑。
e-file可以直接PP，但是在e-file的时候没有PP的选项。你在寄材料的时候把PP的表格
一起附上就可以了。 |
