律师就说，dismiss掉可能，有可能还是infraction，有可能要trial。如果是后2者，
可以过1年2年再expungement。但是期间，不知道雇主看到infraction，或者是
misdemeanor，收回offer的可能有多大？有当HR的同胞来说说么？
还有，就是，律师貌似说infraction是court之内纪录的，不会被背景调查公司access
到。是么？ |

的罚款(<$500)了事。这个是不是在filing 485的时候必须说明，并且附上所有的法庭

同时写了一段话 --- 加入Infraction Deferral Program， 如果通过就不用交罚单，
不扣分。
我应该加入吗？ 这个program到底是什么？
因为几个月前吃了个local的ticket（同一个州），想知道有什么办法抹去记录吗，至
少不扣分。

fine。现在收到那个法院所在county的department of revenue 的bill，项目跟法院那
张一样，同样的3项，一样的数字。
这是需要交第二份的节奏？还是他们政府搞错了？加州，北加的case。谢谢 |

情节。超速虽然也算此类，但不致于上纲上线。但是如果是此女孩儿的情况，一定要谨
慎处理。包括之前有人问迟交超速罚款而收到的第二个infraction（不知道有没有被法
院要求去警察局打指纹），这个都要谨慎处理。如果你在485时不主动交代第二个
infraction，很可能被移民局认为是藐视法律+隐藏不报，因为此infraction 非彼

首先承认，我是新手，对钓鱼法规完全是一知半解，也没有带什么量尺，就在网上买了
个鱼证就去了。然后事情的经过是这样……地点是三藩附近的half moon bay，就站在
岸边钓的那种。 差不多中午才到，站了三个小时几乎没有啥鱼。到了下午才钓到了三
条，其中有一条稍大的扁鱼，比较兴奋。后来就钓到了两条小的一条中的石斑。就是那
两条小石斑让老子吃了ticket。我完全不知道小鱼要放回水中，钓上来就使劲把钩子抠
出来，之后两条鱼就奄奄一息了，我就把它们放在小水塘里。一会儿就看着一个渔警从
上面下来，我以为就是查查证啥的，谁知节外生枝，看完证，说，我在上面看了你25分
钟了，看到你钓到好几条鱼，然后就在地上找，找到了四条鱼，说其中两条是“未成年
”，让我跟他走一趟。上去就把鱼摆成一排，拍照，然后给了我罚单。

之类的。
网上查到的一些：

抓到了，罪名是钓到一个udersize的dungeness crab。娘当时不懂，就把螃蟹扔回去了
。officer就怒了。那个人见我娘是探亲的，就要把罪责加给我,misdemeanor。螃蟹是
我娘钓的，不是我做的，于是我通过学校推荐找到美国律师，他说全权代理不用我出庭

出庭两次，第二次在11月份，我要准备考试就拖12月份才联系他。但是他出国度假就一

发帖数: 13 | 41 本来是车左转向灯坏啦，到处急着找修车店，在一个十字口红灯右转时，因为怕抢不到
最左边的道而急加速冲了出去，很不巧路口处也刚好有个警察，当然被盯上也就顺理成
章啦。。。听到警车鸣笛，我就很知趣地pull over我的车啦。
刚开始以为警察是要说我的车灯坏了，接着才意识到是超速啦（speed limit 45mph,
貌似说我一度飙到60mph啦）。Cop让我在车里等候，他在警车了倒腾了几分钟，罚单就
过来啦~这可是来美的第一张罚单啊，我前前后后逐字逐句阅读了好几遍。。。

正我得的是比speeding ticket高的，那就是Misdemeanor了。你是Infraction就更不用

美国70%以上人有infraction, 但是注意: infraction属于crime.
你的infraction应该属于traffic ticket类(double check: citation#中有TR两个
letters)
既然属于crime, background check中会出现. take it seriously.
建议尽量fight这个citation, 特别是初犯的话. 了解一下有没有什么办法能dismiss这
个ticket, 比如一定时间社区服务.
美国的traffic court就是joke, 一堆人象赶鸭子一样去court,每个人只有几分钟的时
间convince judge.

http://www.avvo.com/ask-a-lawyer, 问问题或找律师(很多人有免费咨询), 也许只有几百美元律师就可以帮助出庭argue或者有其他dismiss ticket方法, 考虑到以后可能的trouble, 还是值得破财消灾的. |

infraction不是crime.
a civil infraction is a non-criminal violation of a rule, ordinance, or
regulation
背景调查也基本查不出来，因为都是问你有没有commit crime or misdemeanor,
infraction比misdemeanor还低一级。
楼主这个属于traffic court管辖，如果实在担心，并且有时间，就去上庭fight一下，
当面和法官解释一下情况，也算是了解一下美国的法律体系的运作情况。

交钱就不用上庭, 但这是等于认了罪, 会留案底。
建议你首先要确定自己犯的是什么级别的罪: 是infraction, 还是misdemeanor? 罚单上应该
写具体你犯了哪(几)条罪, 及其编号。上网查一下编号就知道了。
如果是infraction, 不打紧, 交了罚款由它去吧。
如果是misdemeanor而你又不想留案底的话, 除了请个律师帮你上庭打官司, 我不知道其
它更好的办法。即便有律师, 如果人赃俱获的话, 估计很难完全洗脱掉。在这种情况下, 你的
goal应该是把misdemeanor搞成infraction。
