我當過一天，第一輪沒有過。
主要是因為我時間上跑不過來，聯邦法庭在長島一個鳥不拉屎的地方，
去一次來回四小時。
普通人的陪審團是過去的事情，
現在什麽職業都得去，可能因為紐約案件太多，我們所里隔三差五就被招去了，
一資深老頭律師還去當過幾次head juror。
現在大概學科學的更容易被刷下去，
要是個刑事案，再請倆法醫啥的，
學醫的就鐵定坐不了陪審席了。 |

对西方司法的制度公正性，倍感失望
检辫双方都是选容易操纵控制的人（几乎就是 naive 这种人）为优先
硅工硅婆，具有理性思考能力的人，通常被请回去
而很多案子，都在 plea bargain 就解决了
检察官通常对一个普通嫌犯，下重手控告几十条的罪名，要求50年100年的定罪
以此换取嫌犯认罪，例如认其中一条10年的罪
认罪后，不必经过陪审团审判，大家都省事
这结果是，犯大罪的嫌犯，bargain 结果少了应得刑期
但是对于无辜的嫌犯，因为害怕万一被脑残的 jury 定罪，不如认了轻罪，造成冤狱
这是对人权的另类践踏
有人说，jury 有12个人，不会都是脑残
实际上会有少数头脑清楚的人
但是，担任 jury,枯燥无聊，久了谁都想回去正常生活工作

murder (1), manslaughter (2)。估计GZ知道后会惊出一身冷汗，真是鬼门关前走一趟。
好像女的更容易爱心泛滥。今天在车上听当地电台节目，一男一女两个主持人谈对这个
案子的体会。女的说很为TM的母亲感到sad，一个child出门买点东西，然后给人跟踪了
，然后就翘了。男主持人强烈反对。说起自己5，6年前在Boston给teenagers打了，原
因是这帮小孩在街上玩一种游戏，比赛谁能把路人一击击倒。当时他的朋友给面门上来
了一家伙倒地，他自己给打在肚子上了，没倒下，自己在努力呼吸，当时怀疑给刀扎了
。他的朋友冲他喊“fall, fall”，因为担心他继续挨揍。男主持人说，当时他如果有

然后先排除的是二级谋杀
然后大家开始看过失杀人，因为法官故意把instruction中过失杀人的部分搞的很模棱
两可，所以陪审员很困惑，然后问了问题，律师和检察官解释以后，就排除了过失杀人
MARK GERAGOS昨天说了一句非常有水平的话：“我两周前就说，如果是这几个陪审员的
话，这个案子就不用审了，因为他们对tm没有同情心。” |
